الملخص
هدف البحث إلى مناقشة الضوابط الحاكمة لصناديق الاستثمار في سوق الأوراق المالية من منظور الاقتصاد الإسلامي، بالإضافة إلى تحليل الأداء الحالي لهذه الصناديق وتحديد التحديات التي تواجهها، واعتمد الباحث المنهج التحليلي لفحص الممارسات الحالية والمبادئ الشرعية المتعلقة بتلك الصناديق، وقد توصل البحث إلى أهمية التزام تلك الصناديق بالضوابط الشرعية لتحقيق التوازن بين الدوافع الاستثمارية والمحافظة على مبادئ الشريعة الإسلامية، كما قدم الباحث تصورًا مقترحًا يهدف إلى تحسين الاستفادة من صناديق الاستثمار من خلال تطوير أطر قانونية واضحة لتعزيز الثقافة المالية الإسلامية لدى المستثمرين، ويتضمن التصور أيضًا أهمية تعزيز الشراكات بين المؤسسات المالية والهيئات الشرعية، مما يسهم في تعزيز الثقة في هذه الصناديق وتحقيق التنمية المستدامة في السوق المالية.
Abstract
The aim of the research is to discuss the regulatory frameworks governing investment funds in the stock market from the perspective of Islamic economics, as well as to analyze the current performance of these funds and identify the challenges they face. The researcher employed an analytical approach to examine current practices and the Shariah principles related to these funds. The study concluded that it is crucial for these funds to adhere to Shariah guidelines in order to balance investment motivations with the preservation of Islamic principles. Furthermore, the researcher proposed a conceptual framework aimed at enhancing the benefits of investment funds by developing clear legal frameworks to promote Islamic financial literacy among investors. This proposal also emphasizes the importance of strengthening partnerships between financial institutions and Shariah bodies, contributing to increased trust in these funds and achieving sustainable development in the financial market.
