الملخص
يستقرأ البحث بعض الأعراف السائدة في دولة غامبيا المتعلقة بأركان عقد النكاح وشروطه، ويبين أحكامها ومدى شرعيتها في الفقه الإسلامي.
وقد استخدمت الدراسة المنهج الاستقرائي والمنهج الوصفي والمنهج التحليلي، وتوصلت إلى أن هناك أعرافاً متعلقة بأركان عقد النكاح وشروطه في غامبيا، وفي غيرها من الدول أيضاً، تخالف أحكام الشريعة الإسلامية، ويترتب عليها ضياع للحقوق وآثار سلبية على الأفراد والمجتمع بشكل عام، وبينت الدراسة البدائل الشرعية لها، وختمت ببعض التوصيات.
Abstract
The research explores some of the prevailing customs in the state of the Gambia related to the elements and conditions of the marriage contract, and shows their provisions and the extent of their legitimacy in Islamic jurisprudence.
The study used the inductive approach, the descriptive approach, and the analytical approach, and concluded that there are customs related to the pillars and conditions of the marriage contract in the Gambia, and in other countries as well, that violate the provisions of Islamic law, and result in loss of rights and negative effects on individuals and society in general. her, and concluded with some recommendations.
