الملخص
جرت عادة أئمة الفقه والفتوى أن لا يقولوا قولاً إلا وله دليل يسنده ؛ أما الآراء التي لا مستند لها فإنها تردُّ ولا تقبل؛ ومن العبارات التي تدل على ردهم لها قولهم: هذا تحكّم؛ أو تحكّم لا دليل عليه؛ وقد جاء هذا البحث لدراسة بعض المسائل التي قال ابن قدامة (ت ــــــ 620هـ) عن بعض الأقوال التي قيلت فيها بأنها تحكّم أو لا دليل عليها؛ وقد تطرق الباحث فيه لعدة مباحث كانت على النحو التالي: تعريف التحكم؛ والزكاة في المتولد بين الوحشي والأهلي؛ ومضاعفة العُشر على أهل الذمة إذا شروا الأرض العُشرية؛ ووجوب الفطرة على من تبرع بمؤنة إنسان في شهر رمضان؛ واشتراط نية الصوم في النصف الأخير من الليل؛ والواجب في قضاء رمضان عن كل يوم أفطره بلا عذر؛ وإذا حاضت المرأة وهي معتكفة في المسجد.
والله أسأل أن يتقبل ذلك ويجعله خالصاً لوجهه الكريم ؛ وينفع به؛ ويتجاوز عن التقصير.
Abstract
The jurists and the juris-consults are known for not making any statement without a proof to back it, as for the opinions without a proof they shall be rejected and not accepted. Among the expressions that refer to their rejection of it is their statement: this is taḥakkum(an arbitrary ruling) without proof. This research sought to study some issues that Ibn Qudāmah (d. 620) said regarding some of the opinions regarding them that they are arbitrary without proofs. The researcher discussed certain topics under the issue, as following: a definition of taḥakkum and its reasons, and the zakat on the product of the hybrid of a wide and a domestic animal, and doubling the one-tenth tax on the people of treaty when they buy from the land of one-tenth tax, and the mandatory of fas-breaking mean on whoever offered to sponsor the feeding of another person in the month of Ramadan, and making the intention of fasting a condition in the second half of the night, and what is required from whoever is paying back the days missed in Ramadan without reason, and regarding a woman who saw her menstrual blood while doing I’tikāf in the mosque.
