الملخص
تناول هذا البحث المعنون (حكم الأخذ بأقل ما يطلق عليه الاسم أو أكثره وأثره في اختلاف الفقهاء) دراسة المسائل المتعلقة به في العبادات وغيرها وبيان أقوال العلماء فيها مع ذكر أدلتهم والترجيح بين الأقوال. وقد اشتمل البحث على مقدمة وتمهيد ومبحثين وخاتمة. أما المقدمة فقد ذكرت فيها أهداف البحث وخطة البحث ومنهجه. والتمهيد في تصوير عنوان البحث.
والمبحثان الأول: في حكم الأخذ بأقل ما يطلق عليه الاسم أو أكثره في مسائل العبادات
الثاني: في حكم الأخذ بأقل ما يطلق عليه الاسم في غير العبادات.
· نتيجة البحث:
بيان أهمية معرفة أسباب اختلاف الفقهاء وأنها تُعين على معرفة مأخذهم وممسكهم في تلك المسائل.
– أن الاشتراك اللفظي سبب من أسباب الخلاف في المسائل الفقهية.
– أن الأخذ بأكثر ما يطلق عليه الاسم أحوط للعبادة وأبرأ للذمة.
Abstract
This Research, entitled (The Ruling on Adhering to the Less or More of What is Called by Name and Its Effect on the disagreement of Jurists), studying the issues related to it in acts of worship and other things, explaining the statements of the scholars regarding them, while mentioning their evidence and the weighting between the statements . The research included an introduction, preface, two sections, and a conclusion. As for the introduction, mentioned the research objectives, research plan and methodology. the introduction to depicting the title of the research. The two topics: First :- on the ruling on adopting the least or most of What is Called by Name in matters of worship . The second: regarding the ruling on adopting the least of what is given by name in matters other than acts of worship.
· Result of The Research :-
Explaining the importance of knowing the reasons for the disagreement of jurists and that it helps in knowing their approach and position on these issues.
– Verbal participation is one of the causes of disagreement in jurisprudential issues .
– Adopting most of what is called by name is more prudent for worship and clears one’s obligation.
