الملخص
يهدف هذا البحث إلى تحديد الأخلاقيات والآداب الواجب توافرها في شخصية المفتي، مع تسليط الضوء على دوره الحيوي في مراعاة الخلاف داخل المجتمع الإسلامي. اعتمد الباحث على تحليل نصوص الشريعة الإسلامية من القرآن والسنة، واستند إلى آراء علماء الفقه وأصوله في تحديد تلك الأخلاقيات والآداب.
يؤكد البحث على الدور المحوري للمفتي في بناء مجتمع متماسك من خلال إصدار الفتاوى المسؤولة التي تراعي التغيرات الزمنية والمكانية. كما يقترح الباحث أهمية إجراء بحوث معمقة حول تأثير التكنولوجيا الحديثة على عملية الإفتاء وآليات تبسيطها للأفراد.
وقد توصل البحث إلى عدد من النتائج المهمة، من أبرزها:
1. دور المفتي: تأكيد أهمية دور المفتي كمرجع ديني أساسي في حياة المسلمين.
2. الصفات المطلوبة: تحديد الصفات الشخصية والعلمية المطلوبة للمفتي، مثل العدالة، التواضع، معرفة أحكام الشريعة، والإلمام بالأعراف الجارية.
3. مراعاة الخلاف: إبراز أن مراعاة الخلاف ليست فقط ضرورة شرعية، بل تسهم في تعزيز التلاحم الاجتماعي.
Abstract
This study aims to define the ethics and etiquettes that a Mufti should embody, with a particular emphasis on his crucial role in addressing scholarly disagreements within the Islamic community. The researcher analyzed Islamic texts from the Qur’an and Sunnah and examined the views of jurists and scholars to establish these ethical and behavioral guidelines.
The study highlights the Mufti’s pivotal role in fostering a cohesive society through the issuance of responsible fatwas that take into account temporal and spatial changes. Additionally, the researcher underscores the necessity of conducting in-depth studies on the impact of modern technology on the fatwa process and methods to enhance accessibility for individuals.
The research yielded several key findings, including:
1. The Role of the Mufti – Affirming the Mufti’s status as a primary religious authority in the lives of Muslims.
2. Essential Qualifications – Identifying the required personal and scholarly attributes of a Mufti, including justice, humility, a deep understanding of Islamic rulings, and awareness of prevailing customs.
3. Consideration of Disagreement – Demonstrating that acknowledging scholarly disagreements is not only a religious obligation but also plays a vital role in strengthening social cohesion.
