الملخص
يتناول هذا البحثُ المسائلَ الأصولية التي خالف فيها ابنُ حزم (ت456هـ) الظاهرية، سواءٌ كان خلافُه لجمهورهم، أو لبعضِ أعلامهم، كمخالفته لداودَ الظاهري (ت270هـ) أو ابنِه محمد بن داود (ت297هـ) أو ابنِ المغلس (ت324هـ)، أو لبعضِهم ممن لم يصرح به، وقد وقفتُ على اثنتي عشرة مسألة أصولية خالف ابنُ حزم فيها.
ومقصود البحث الوقوف على الخلاف الأصولي في المذهب الظاهري، رغبة في التعرف على المذهب من خلالها، والاطلاع على موقف ابن حزم في تلك المسائل، والتعرف على منهج ابن حزم (ت456هـ) مع المخالف الموافِقِ له في المذهب الظاهري.
وقد سلكت منهجًا استقرائيًّا وتحليليًّا، حرَصت فيه على التحقُّق من التمايُز بين المذهب الظاهري، وآراءِ ابن حزم (ت456هـ) المخالِفة في مسائل علم أصول الفقه، وهل هو اختلافٌ في المسائل فقط أو اختلافٌ في المنهج.
Abstract
This research examines the fundamental issues on which Ibn Hazm held divergent views with the Zahirites, whether his divergence was with the majority of Zahirites or with some of their prominent scholars, such as his divergence with Dawud (the Zahirite), his son Muhammad Ibn Dawud, or Ibnul-Mughallis, or with others whom he did not explicitly mention. I have identified twelve fundamental issues on which Ibn Hazm held divergent views.
The purpose of this research is to explore the fundamental divergence within the Zahirite school, with the aim of gaining a deeper knowledge of this school. It also seeks to examine Ibn Hazm’s positions on these issues, and to understand his approach towards others who held divergent views with him within the Zahirite school.
I have adopted an inductive and analytical approach, in which I focus on verifying the distinction between the Zahirite school and Ibn Hazm’s divergent views on issues of the science of Usul Al-Fiqh (Principles of Islamic Jurisprudence), and determining whether these divergences pertain merely to specific issues, or represent a broader methodological divergence.
