الملخص
مع تطور الزمن و والتقدم العلمي والتقني والتكنولوجي العالمي، وكثرة الصناعات والخدمات، وتوسعها كان لزاماً على الباحثين، والفقهاء والعلماء، وطلبة العلم بيان ما يحل وما يحرم من تلك الصناعات، والمنتجات سواء كانت هذه المنتجات غذائية أو دوائية أو مستحضرات التجميل ونحوها من الصناعات، ومن أهم القواعد الفقهية الأصولية التي قعدها العلماء في هذا الباب قاعدة الأصل في الأشياء الإباحة؛ لتكون مرجعاً يستند إليها في بيان كثير من الوقائع والنوازل الحادثة، وقد بنى الفقهاء على هـذه القاعـدة كثيراً من الأحكام الفقهية الكثيرة تدل على رسوخها وأثرها في الفقه الإسلامي، وهي مـن الأصـول القويمة الدالة على اليسر والسماحة والمرونة والشمولية في التشريع الإسلامي. ولذلك رأيت أن أبين في هذه الدراسة أثر قاعدة الأصل في الأشياء الإباحة وتطبيقاتها المعاصرة على صناعة الحلال.
Abstract
With the development of time and global scientific, technical and technological progress, and the abundance of industries and services, and their expansion, it was necessary for researchers, jurists, scholars, and students of knowledge to clarify what is permissible and what is forbidden from those industries and products, whether these products are food, medicine, cosmetics, and other industries. One of the most important fundamental jurisprudential rules that scholars have established in this regard is the rule that the origin of things is permissibility; to be a reference to be relied upon in clarifying many incidents and new developments. Jurists have built many jurisprudential rulings on this rule, indicating its solidity and impact on Islamic jurisprudence. It is one of the sound principles indicating ease, tolerance, flexibility, and comprehensiveness in Islamic legislation. Therefore, I saw that I would clarify in this study the impact of the rule of permissibility and its contemporary applications on the halal industry.
