الملخص
تسعى هذه الدّرَاسِة للكشف عن مَوضوع المقصد الشَّرعيّ مِن إِنشاء مَكاتب للإصلاح والتَّوفيق الأسريِّ في المحاكم الشَّرعية الأردنيِّة وَدوْرُها في علاج مَا يقع مِن خلافات داخلها، وبينت الدّرَاسة مفهوم الإصلاح والتوفيق الأُسريِّ، ومشروعية عمل مكاتب الإصلاح والتوفيق الأسري، كما وأبرزت الدّراسة المقصد الشرعي من إنشاء مكاتب الإصلاح الأسري؛ وكيف سَاهم ذلك في جلبِ المَصْلَحَة والمَنْفَعَة من خلال معالجة الخلافات الزَّوجية بأسهل الطرق وأيسرها وبأسلوب مهنيِّ مَع تأمين جو من السّكينة والمودة بين الزّوجين والسَّعي في ترابط المجتمع، ودفع المَضَرّة والمَفَسدة عن الأسرة المسلمة مِن خِلال مُعالجة أوجه الخلاف قبل أن تصل إلى القضاء، خصوصًا أن هذهِ القضايا تحتاج إلى نفس طويل ويصعُب على القاضي أن يتولى ذلك بنفسه.
واستخدمت الباحثة لبيان ذلك: المَنْهَج الوصفيَّ والاستنباطيّ، وتوصلت الدِّراسة إلى أن المقصد الشَّرعي من إنشاء مكاتب للإصلاح والتوفيق الأُسري في المحاكم الشرعية، يتفق وروح الشَّريعة الإسْلاميِّة، القائمة على المَصْلَحَةِ في تحقيق السَّكن والمودة ودرء مفسدة الطلاق.
Abstract
This study seeks to reveal the subject of the Sharia purpose of establishing offices for family reform in the Jordanian Sharia courts and their role in resolving disputes that occur within them, and the study showed the concept of family reform, and the legitimacy of the work of family reform offices, and the study highlighted the legal purpose of establishing family reform offices, and How did this contribute to bringing interest and benefit through dealing with marital disputes in the easiest ways and in a professional manner while ensuring an atmosphere of tranquility and affection between the spouses, participating in the cohesion of society, and removing harm and corruption from the Muslim family by addressing disputes before they reach the judiciary, especially since these cases require a long breath and it is difficult for the judge to handle it himself.
To demonstrate this, the researcher used the descriptive and deductive methods, The study concluded that the legitimate purpose of establishing family reform offices in the Sharia courts is consistent with the spirit of Islamic law, which is based on interests in achieving calm and affection and eliminating the harm of divorce.
