الملخص
أبحث في مسألة فقهية واقعية من مستجدات الطب المعاصر، وقد تكررت حوادثها كما ذكر ذلك الأطباء، فقمت ببحثها وتقريب النظر لأهل الإفتاء بحسن تصورها، فالحكم على الشيء فرع عن تصوره، وحقيقة المسألة هي:” هل يجوز حصول الزوجة على مني زوجها المتوفى دماغيا لغرض الاستيلاد منه بالتلقيح الصناعي”، وهذه المسألة لم أجد من بحثها في كتاب أو رسالة علمية، ولعل هذا البحث أن يقرب نظر الباحثين في حكمها، وقد أعملت في هذا البحث المنهج الاستدلالي والاستنباطي في معرفة أحكام هذه النازلة الفقهية المستجدة، ملتزما طريقة الباحثين في العزو والاقتباس والتخريج ونحوها.
وقد ناقشت في بحثها موضوعات تمهيدية ذات صلة مثل: المراد بأطفال الأنابيب وحقيقة الوفاة الدماغية، والقرارات الفقهية المتعلقة بهما، ثم قررت الحكم الفقهي في مسألة: حصول الزوجة على مني زوجها المتوفى دماغيا لغرض الاستيلاد منه بالتلقيح الصناعي، وقد خرجت بفضل الله تعالى بعدد من الأحكام والنتائج.
Abstract
I am researching a realistic jurisprudential issue, one of the latest developments in contemporary medicine, and its incidents have been repeated, as mentioned by doctors, so I researched it and approached the scholars of fatwa based on its good perception, for ruling on a thing is separate from its perception, and the truth of the issue is: “Is it permissible for a wife to obtain the semen of her brain-dead husband for the purpose of procreation?” It is through artificial insemination. I could not find any research on this issue in a book or scientific dissertation. Perhaps this research will bring closer the researchers’ consideration of its ruling. In this research, I have used the deductive and deductive method in finding out the rulings of this new jurisprudential calamity, adhering to the researchers’ method of attribution, quotation, and generalization. And so on.
In her research, she discussed related introductory topics, such as: what is meant by in vitro fertilization and the reality of brain death, and the jurisprudential decisions related to them. Then she decided on the jurisprudential ruling on the issue: the wife’s obtaining the semen of her brain-dead husband for the purpose of procreating from him through artificial insemination. She came out, thanks to God Almighty, with a number of rulings. And the results.
