الملخص
عنوان البحث: القول الذي تقتضيه الأصول عند الإمام الأبياري في كتابه شرح البرهان -دراسة تأصيلية-
هدفه: ذكر الأقوال التي يقتضيها النظر الأصولي أو يوجبها مقتضى القواعد والأصول عند الإمام الأبياري في كتابه التحقيق والبيان في شرح البرهان، ثم بيان ما هي تلك القواعد والأصول؟، ودراستها دراسة تأصيلية بذكر محل الاتفاق والخلاف فيها، وبيان ما هو الصحيح في محمل تلك الأقوال بحسب ما ظهر للباحث.
منهجه: يقوم البحث على جمع الأقوال التي يقتضيها النظر الأصولي عند الإمام الأبياري باستقراء وتتبع كلامه في كتابه التحقيق والبيان في شرح البرهان، وإبراز تلك القواعد والأصول التي استوجبت تلك الأقوال، وتوثيق ذلك ودراسته دراسة علمية تأصيلية.
أهم النتائج:
1. الصلة الوثيقة بين قواعد الأصول بعضها ببعض، وأن القول في بعضها أحيانًا يوجب القول بمثله في البعض الآخر.
2. معرفة مآخذ الأقوال، والترجيح بينها.
3. أن الإمام الأبياري من أبرز العلماء الذين سعوا في مناقشة الأقوال والرد عليها والترجيح بينها.
4. أن غالب الأقوال التي تقتضيها بعض الأصول والقواعد هي أقوال يصدق ربط صحتها بتلك الأصول والقواعد، ولكن تحتاج إلى تحقيق وجه الربط بينها.
5. أن من أوجه الترجيح بين الأقوال الترجيح بالنظر الأصولي المتفق عليه والترجيح بالأصول والقواعد المسلم بها.
6. أن الأصول والقواعد التي اعتمد عليها الأبياري في تصحيح بعض الأقوال ترجع إلى ما يلي: اشتراط القطع في إثبات المسائل الأصولية، وأن الاحتمال إذا تطرق إلى الدليل أسقط الاستدلال به، وأن الدليلين إذا تساويا ولا مرجح لأحدهما وجب تساقطهما، وأنه لا يرجح بما ليس بحجة، وأن الأصل في الألفاظ والعبارات النظر إلى لغة العرب وما تحتمله من أحكام، وأن الحجة لا تترك إلى ما ليس بحجة.
Abstract
Subject: The principled opinion as necessitated by the fundamentals, as expounded by Imam Al-Abiyari in his book Sharh Al-Burhan – Fundamental Study –
Objective: To delineate the opinions necessitated by the principles of fundamental or mandated by the dictates of foundational principles and rules, as presented by Imam Al-Abiyari in his book “Al-Tahqiqwa Al-Bayan fi Sharh Al-Burhan”. Subsequently, to explicate these principles and fundamentals, conducting a comprehensive fundamental study by elucidating areas of consensus and divergence, and elucidating the most accurate interpretation of these opinions based on the researcher’s analysis.
Methodology: The research is based on collecting the opinions necessitated by the principles of fundamental according to Imam Al-Abiyari, through examining and tracing his discourse in his book ” Al-Tahqiqwa Al-Bayan fi Sharh Al-Burhan”. It aims to highlight the principles and fundamentals that led to these opinions, documenting and studying them in a comprehensive scholarly analysis.
Key Findings:
The close correlation among the principles of fundamentals, where some are intricately interconnected, and that a ruling in some of them sometimes necessitates a similar ruling in others Understanding the foundations of opinions and discerning between them Imam Al-Abiyari is one of the foremost scholars who actively engaged in discussing various opinions, responding to them, and adjudicating between them The majority of opinions necessitated by certain principles and fundamentals are opinions whose validity is believed to be closely linked to those principles and rules. However, they require achieving the exact nature of this connection. One of the most precise aspects of adjudicating between opinions is the meticulous consideration of the unanimously agreed-upon foundational principles and the established principles and fundamentals. The foundational principles and rules relied upon by Al-Abiyari in rectifying some opinions are due to the following: Requiring certainty for establishing fundamental matters, dismissing probabilistic arguments once evidence is presented. When two pieces of evidence hold equal weight and there is no preference for either, they should be discarded. Furthermore, arguments lacking valid evidence should not be prioritized. In terms of language and expressions, the standard is to consider the Arabic language and its legal implications. Additionally, arguments should always be grounded in valid evidence.
