الملخص
عالج البحث مقصدًا من المقاصد الجزئية التي تضمّنتها الأحكام الشرعية، ليُسهم في مزيد من الدراسات لهذا النّوع من المقاصد التي لم تحض بالعناية الكافية؛ ليُستفاد منها في الوقوف على حِكم الشارع فيما أمر ونهى فينساق إلى الامتثال لها، مطمئنةً نفسه إلى خيريّة التشريع الإلهيّ، ويكسِب الباحث والدّارس ملكة التّقصيد وتوظيف هذه المقاصد في الاستدلال بالقياس والمصالح.
والمقصد الجزئي محلّ البحث هو: “استخلاص الشّكر من المكلف”، ومعناه: استخراج شكر الله تعالى من المكلّف لِمَا منّ به سبحانه عليه من النّعم الماضية والحاضرة والمتجددّة على ما جاءت به شريعته سبحانه.
وقد قدّم البحث صورًا تطبيقيةً لهذا المقصد من كتاب العبادات، ولم يقف عنّد ذلك بل تجاوزه إلى كشف العلاقة بينه وبين المقاصد الكلية الكبرى في الشريعة الإسلامية.
والبحث في هذا النموذج من المقاصد الجزئية يؤكّد على:
أنّ الأحكام الشرعية تتضمّن حكمًا شرعيةً.
وإمكان الكشف عنها، دون إلغاء ما تقرّر شرعًا من التّسليم والانقياد إلى كلّ ما صحّ عن الشّارع الحكيم من كتاب أو سنّة ظهرت لنا حكمته أو غابت؛ ليقيننا بقِصَر علمنا، ومحدوديّة فهمنا، وعجزنا عن إدراك حكمة ما غاب عنا، واعتقادنا الجازم أنّ العليم الحكيم الرؤوف الرحيم – سبحانه – لا يكلّف عباده إلّا بما فيه حكمة.
وأنّ المقصد الجزئي لا يمكن أن يكون مبتورًا عن المقاصد الكلية للشريعة، بل يرتبط بها ارتباطاً وثيقاً؛ لأنّ المقاصد الكلية والخاصة وحدةٌ واحدةٌ متكاملة دالّة على معانٍ وحكم خادمة للحكم الشرعي.
Abstract
The research delves into a specific objective among the partial purposes encompassed by legal provisions, intending to contribute to further studies on these objectives that have not received sufficient attention. The aim is to benefit from them in understanding the wisdom of the divine law in what it has commanded and prohibited, leading to adherence. The individual is assured of the goodness of divine legislation, and the researcher and student gain the ability to precisely define and apply these objectives in inference through analogy and consideration of interests.
The specific objective under investigation is “Extracting Gratitude from the Obligated.” Its meaning involves extracting gratitude to Allah the Almighty from the obligated individual for the past, present, and renewed blessings bestowed upon them in accordance with His divine law.
The research provides practical examples of this objective from the book of worship, extending beyond to reveal the relationship between it and the overarching purpose in Islamic jurisprudence. This model of specific objectives in the research confirms:
– That legal provisions encompass a legitimate wisdom.
– The possibility of uncovering them without negating submission and adherence to everything authenticated by the wise legislator from the Qur’an or Sunnah, regardless of whether its wisdom is apparent to us or it is hidden.
This assures our awareness of the limitations of our knowledge, understanding, and our inability to grasp the wisdom of what eludes us, as we firmly believe that the All-Knowing, the Wise, the Compassionate, and the Merciful – may He be glorified – does not burden His servants with anything except with that which holds wisdom.
Moreover, the specific objective cannot be severed from the overall objectives of Sharia but is intimately connected to them. The general and specific objectives form a unified and integrated entity, indicative of meanings and rulings serving the legal judgment.
