الملخص
تناول البحث موضوع دور الاقتصاد الإسلامي في تحقيق مقاصد الشريعة في محاولة للوقوف على مدى توافق الاقتصاد الإسلامي مع مقاصد الشريعة، حيث أن مقاصد الشريعة تساعد في ضبط بوصلة الاقتصاد الإسلامي، وقد هدف البحث إلى ذكر تطبيقيات عملية لبعض المنتجات التمويلية، ومعرفة مدى محاكاتها للمنتجات التقليدية أسلوباً أو أثراً، وقد اشتمل البحث على تمهيد وأربعة مطالب: المبحث التمهیدي تناول المفاهيم المتعلقة بموضوع الدراسة من حیث التعريف بمفهومي الاقتصاد الإسلامي ومقاصد الشريعة.
والمطلب الأول: ذكر أهمية المقاصد في الشريعة الإسلامية. أما المطلب الثاني: فكان يدور حول موضوع المقاصد في المعاملات المالية المعاصرة
والمطلب الثالث: وضح العلاقة بين المقاصد الشرعية وعلم الاقتصاد الإسلامي وذلك للربط بين مواضيع الدراسة.
وأخيراً المطلب الرابع: جاء فيه ذكر بعض التطبيقات الاقتصادية التي تحقق مقاصد الشريعة (السَلَم، المضاربة، القرض، التورق، المرابحة)، وتوصل إلى عدة نتائج، أهمها: أن علم المقاصد الشرعية يعتبر موجه للاقتصاد الإسلامي، بحيث لا يحيد عن مساره الصحيح.
كما أشار إلى دور عقد السَلَم بهندسته الاقتصادية الإسلامية في تحقيق مقاصد الشريعة، والحث على التنمية الزراعية والصناعية -بشكل خاص- وغيرها من الأنشطة الاقتصادية، وللمضاربة مقصدًا عظيمًا من مقاصد الشريعة، وذلك بدوران المال وانتفاع الناس بعضهم من بعض، ويستحب كتابة العقد للتوثيق.
كما أوصى البحث بحصر جميع مقاصد الشريعة في التطبيقات الاقتصادية، وإعدادها بمشروع في سلسة من الرسائل العلمية، لجمع الشتات وإبراز جمال ودور الاقتصاد الإسلامي -بشكل خاص-، وأهمية الشريعة الإسلامية ومقاصدها -بوجه عام-.
Abstract
The research dealt with the role of the Islamic economy in achieving the purposes of the Shari ‘a in an attempt to determine the compatibility of the Islamic economy with the purposes of the Shari’ a. The research aimed at mentioning practical applications of certain financing products, and knowing the extent to which they emulate traditional products in a style or effect. The research included preparation and four demands: Preliminary research addresses the concepts related to the subject matter of the study by introducing the concepts of Islamic economy and sharia purposes.
The first requirement: to mention the importance of purposes in Islamic law. Second requirement: on the subject of purposes in contemporary financial transactions
The third requirement clarified the relationship between sharia purposes and Islamic economics in order to link the study’s subjects.
Lastly, the fourth requirement mentioned some economic applications that fulfil the purposes of the Shari ‘a (peace, speculation, loan, securities, murabaha) and reached several conclusions, the most important of which is that the science of Shari’ a purposes is geared towards the Islamic economy, so that it does not derail its proper course.
He also referred to the role of the Peace Contract with its Islamic economic engineering in achieving the purposes of the Shari ‘a, urging agricultural and industrial development in a special form and other economic activities, and speculating a great purpose of the Shari’ a, by turning money and benefiting people from each other, and desiring to write the contract for documentation.
The research also recommended limiting all Shari ‘a purposes to economic applications, preparing them with a project in a series of scientific messages, to collect the diaspora and highlight the beauty and role of the Islamic economy in particular, and the importance and purposes of the Islamic Shari’ a in general.
