الملخص
التأصيل أمر أجمع عليه أهل العلم في المؤلفات الفقهية، وقد استعمله الفقهاء في العديد من المؤلفات بصور متعددة وألفاظ متنوعة وغايات مختلفة، ويعد كتاب بداية المجتهد وكفاية المقتصد للشيخ أبي الوليد محمد بن أحمد بن رشد الشهير بابن رشد الحفيد المتوفى في 595ه من أكثر الكتب استعمالاً للأصول، ونظراً لكثرة استعمال ابن رشد لمصطلح الأصل، احتاج الأمر إلى التفريق بين أنواع الأصول التي استعملها ابن رشد وأقام عليها كتابه، وبيان قصده الأعظم في استعماله لمصطلح الأصل، مع دراسة كيف استعمل التأصيل لبيان الأحكام الفقهية، والفائدة التي قصدها في استعماله لهذه الأصول التي بنى عليها كتابه، وذلك كله تحت عنوان:
الأصل الفقهي عند ابن رشد الحفيد في كتابه بداية المجتهد وكفاية المقتصد حقيقته وفوائده.
وتم التركيز في هذا البحث على تحرير مصطلح الأصل الفقهي عند ابن رشد، وكيف استعمله في كتابه بداية المجتهد، وبيان مراده وقصده منه، والفوائد المتحققة منه، مع مقارنة نظرة ابن رشد للأصل مع نظرة غيره من الفقهاء.
وقد اعتمدت في البحث المنهج النظري للوصول إلى النتائج والتوصيات.
وخلص البحث إلى تحديد تعريف للأصل الفقهي، وبيان مراد ابن رشد في استعماله للأصول، إضافة إلى إثبات تطابق نظرة ابن رشد لمعنى الأصل مع نظرة غيره من الفقهاء، مع ذكر خصائص الأصول والفوائد المتحققة منها.
Abstract
Rooting of science is something that scholars have agreed unanimously on it in jurisprudential literature , and Jurists have used it in many writings in multiple forms, with various words for different purposes ,The book “ALBIDAYA WALNIHAYA” by Ibn Rushd Al-Hafid is one of the books that most uses principles , Due to Ibn Rushd’s frequent use of the term principle , It was necessary to differentiate between the types of principles that Ibn Rushd used and based his book on it , Explaining Ibn Rushd’s intention in his use of the term principle , With a study of how he used rooting to explain jurisprudential rulings, and the benefit he intended in his use of these principles on which he based his book.
The focus of this research was on editing the term “jurisprudential Principle” according to Ibn Rushd, and how he used it in his book “The Beginning “ALBIDAYA.” And Explaining what he means and intends from it , benefits derived from it , with Comparing Ibn Rushd’s view of the Principle with the view of other jurists.
The research adopted the inductive theoretical approach to reach its goals.
The research concluded with defining a definition of the jurisprudential principle , and Ibn Rushd’s explanation and intention of his use of the principles , In addition to proving the conformity of Ibn Rushd’s view of the meaning of Principle with the view of other jurists and the benefits achieved from it.
