الملخص
تناول البحث شيئًا من التشريعات الوقائية –التي وردت في سورة النساء- لتقي من حصول المشاكلٍ ابتداءً متى ما فُهمت تلك التشريعات وطُبقت بالشكل الصحيح، وهذه التشريعات هي: تقوى الله تعالى ومراقبته وإعلاء مكانة المرأة عمّا كانت عليه قبل بعثته صلى الله عليه وسلم ، وأمر الأزواج بحسن الاختيار، وتعريف كلٍ من الزوجين بطبيعتهما الفطرية وما يجب لكلٍ منهما من حقوق، وما عليه من واجبات، وبيان أن قوام الحياة الزوجية على العدل وعدم الظلم، خصوصاً في حالتي التعدد ونكاح اليتامى، وجعل القوامة للرجل، مع ذكر أسباب هذه القوامة، والواجب على المرأة تجاهها، وهذا ما تناولتُه في الفصل الأول. ولما كان من الأمور المذكورة في هذه السورة: مسألة التعدد، وإباحة الله تعالى للزوج أن يؤدب زوجه عند نشوزها – ولما أثير حولهما من شبهات- ذكرت في الفصل الثاني أقوال العلماء الدالة على أن هذه الشبه لا تقوم على ساق ولا تثبت على أصل، وأنها مجرد ادعاءات الغرض منها تشويه صورة الإسلام، وصد الناس عن أحكامه.
Abstract
The research dealt with some of the preventive legislation – which was mentioned in Surah An-Nisa – to protect against problems starting from when these legislations are understood and applied in the correct manner, and these legislations are: fearing God Almighty, raising the status of women above what it was before his mission, may God bless him and grant him peace, and the matter of husbands . By making good choices , and introducing each spouse to their innate nature and the rights and duties owed to each of them, and explaining that the basis of marital life is justice and the absence of injustice, especially in cases of polygamy and the marriage of orphans, and assigning custodianship to the man, mentioning the reasons for this custodianship, and what is obligatory for the The woman towards her, and this is what I discussed in the first chapter . And since among the matters mentioned in this Surah: the issue of polygamy, and God Almighty’s permission for the husband to hit his wife when she is disobedient – and because of the suspicions that have been raised about them – I mentioned in the second chapter the sayings of the scholars that indicate that this suspicion is not based on a leg or proven on a basis, and that it is merely Allegations aimed at distorting the image of Islam and prevent people from its rulings.
