الملخص
في هذا البحث تطرق الباحث إلى جانب تطبيقي يتعلق بقاعدة (تحقيق المناط) حيث يعنى تحقيق المناط بتحقق وجود الدليل الكلي أو القاعدة الكلية في الصور والجزئيات الفقهية، ومن القواعد الكلية الفقهية المهمة هي القواعد الفقهية المتعلقة بالضرورات، كالضرورات تبيح المحظورات، والتي يكثر استعمالها وتطبيقها، بل ربما حصل خطأ في تطبيقها، جاء هذا البحث لدراسة أثر قاعدة (تحقيق المناط) في ضبط تطبيق تلك القواعد الفقهية المتعلقة بالضرورات، وذلك صوناً لتلك القواعد من سوء استعمالها في غير محالها.
وسار الباحث في منهجه المنهج الوصفي التحليلي، وكانت أهم نتائج البحث التي توصل لها الباحث:
-أهمية العناية بتحقيق المناط، حيث يقع عليها نصف الاجتهاد، وهو تطبيق الأحكام على الوقائع.
-تطبيقات قواعد الضرورات مما تعم بها البلوى، مما يستدعي الحاجة إلى العناية بنشر هذه القواعد وضوابطها بين الناس.
-قد يقع تحقيق المناط من غير أهل الاجتهاد ضرورة، كما يضطر المضطر إلى تحقيق مناط الضرورة حتى وإن لم يكن من أهل الاجتهاد.
Abstract
In this study, the researcher delved into an applied aspect related to the principle of ‘realizing objectives,’ which entails achieving the overall evidence or general principles in the legal texts and jurisprudential details. Among the important general jurisprudential principles are those associated with necessities, such as necessities permitting prohibitions, which are frequently used and applied, potentially leading to errors in their application. This research aimed to examine the impact of the principle of ‘realizing objectives’ on regulating the application of these jurisprudential rules related to necessities, aiming to safeguard these rules from misuse in inappropriate contexts.
The researcher followed a descriptive-analytical methodology, and the key findings of the study included:
The importance of paying attention to realizing objectives, as it constitutes half of the scholarly effort, involving the application of legal rulings to real-life situations.
Applications of the principles of necessities to alleviate hardships, necessitating the dissemination of these principles and their guidelines among people.
Realizing objectives might become a necessity for those not versed in scholarly exertion, just as a person in dire need is compelled to realize the objectives of necessity even if they are not scholars.
