الملخص
تم السير في البحث وفق المنهج الاستقرائي، ومنهج البحث المقارن، ويهدف البحث إلى جمع المسائل الفقهية التي للغنى والفقر أثر فيها في كتاب الزكاة من خلال الكتب المتنوعة في المذاهب الأربعة، ودراستها دراسة فقهية مقارنة، والجواب عن ما هو أثر الغنى والفقر في تلك المسائل، وتم دراسة المسائل ببيان ما هو محل اتفاق بين العلماء فيها، وما هو محل خلاف بينهم، وذكر أقوال الفقهاء داخل المذاهب الأربعة فيها، وبيان الراجح في تلك الأقوال مع دليله، وقد انتظم البحث في مقدمة، ومبحثين، وخاتمة، وفهارس. المبحث الأول: في التعريف بمفردات العنوان، وفيه تعريف الزكاة، وتعريف الغنى، والفقر، وأما المبحث الثاني ففيه المسائل الفقهية التي تختلف بحال الفقر والغنى في كتاب الزكاة، في عشرة مطالب، وظهر من خلال البحث أثر الفقر والغنى في عدد من مسائل كتاب الزكاة، وخلاف العلماء فيها.
Abstract
The research adopted an inductive and comparative research method. The research aims to gather jurisprudential issues, in which the effect of wealth and poverty can be found in the book of zakat through various books of the four schools of thought, to conduct a comparative jurisprudential study, and to answer the effect of wealth and poverty on those issues. The issues were studied by clarifying the subject of agreement and disagreement among the scholars on them; the jurists’ opinions within the four schools of thought were explained on them, the preponderance opinion among others was explained with evidence. The research contains an introduction, two sections, a conclusion, and indexes. The First topic is the definition of the title terms: which includes definition of zakat, definition of wealth and poverty. The second topic includes the jurisprudential issues that differ according to the state of poverty and wealth in the book of zakat, divided into ten subtopics, the study shows the effect of poverty and wealth in a number of zakat book related topics and the scholars’ different opinions on them.
