الملخص
رياضيات أصول الفقه هي: مسائل أصوليّة فائدتها ترويض ذهن الدّارس وتمرينه على دَرْك مآخذ المسائل والاستدلال لها، وقد تناولتها في هذا البحث بالدراسة النظريّة والتطبيقيّة، أما الدراسة النظريّة فقد انتظمت في خمسة مباحث: أولها: مفهوم رياضيات الأصول، وثانيها: بيانٌ لموقف العلماء من رياضيات الأصول، وثالثها: خصائص رياضيات الأصول، ورابعها: تسميات العلماء لرياضيات الأصول، وآخرها: فائدة رياضيات الأصول.
وأما الدراسة التطبيقيّة فقد جمعت المسائل التي وُصفت بأنها من رياضيَّات الأصول، وهي عشر مسائل، ودرستها دراسة تبرز صورتها، وتراجمها عند الأصوليين، ومذاهب العلماء فيها، وأبرز أدلتهم، وكلامهم عن فائدتها.
وقد خلُص البحث إلى نتائج أبرزها:
1- أن إيجاد الأصوليّين لهذا النوع من المسائل له سبب وجيه، وهو: الارتياض والتدرّب على النظر ففائدتها الرياضة النظرية ؛ لتسهل على الدارس معرفة المسائل الضرورية، فمثلًا مسألة الأمر للوجوب أو الفور، والنهي يقتضي الفساد، ونحوها هذه مسائل من ضروريات علم الأصول؛ لأنه يترتب عليها فروع فقهية، أما مسألة: مبدأ اللغات، أو هل العموم من عوارض الألفاظ أو المعاني؛ فهي لا تترتب عليها فائدة من جهة الفروع الفقهية؛ ومع ذلك نجد العلماء يعتنون ببحثها؛ بل والإطالة فيها أحيانًا، ثم يختمون ذلك بالتصريح: أن هذه المسألة لا تترتب عليها فائدة فقهية؛ لكنها ذُكرت للارتياض، وهذا أمرٌ معروفٌ معهودٌ في كثير من العلوم.
2- أن الدعوة إلى حذف هذا النوع من المسائل إعدامٌ لهذه الفائدة القيِّمة المعهود الالتفات إليها في عدد من العلوم الشرعيّة، وغير الشرعيّة، والتي نصَّ عددٌ من أفذاذ الأصوليّين على أهمّيّتها.
أن بعض هذه المسائل قد رتّب بعض العلماء عليها ثمرات فقهية؛ فهي غير مجمع على عدم فائدتها الفقهيّة، وقد بيّنت ذلك في الدراسة التطبيقيّة
Abstract
Cognitive training in the fundamentals of jurisprudence are fundamental issues whose benefit is cultivating the mind of the learner and training him to grasp the implications of the issues and the reasoning for them. I dealt with that in this research through theoretical and applied study. The theoretical study was structured into five sections: the first: the concept of cognitivism of the fundamentals of jurisprudence, and the second: an explanation of the scholars’ position on the cognitivism of the fundamentals. The third: the characteristics of the cognitivism of the fundamentals, and the fourth: the scholars’ designations for the cognitivism of the fundamentals of jurisprudence, and the last: the benefit of the cognitivism of the fundamentals. The applied study collected the issues that were described as being from the cognitivism of fundamentals, which are ten issues, and I studied them in a study that highlights their forms, their explanation according to the scholars, and the scholars’ position on them, and their most significant evidence and what they said about its usefulness.
The research arrived at results, the most important of which are:
1. The scholars of the fundamentals of jurisprudence finding this kind of issue has a good reason, which is being drilled and trained in observation. Thus, its benefit is theoretical exercise; to make it easier for the student to know the necessary issues, for example, the issue of “command is for obligation or immediacy” and “prohibition is necessitated by vice and the like”. These are issues from the necessities of the science of fundamentals of jurisprudence; because it entails jurisprudential offshoot. As for the issue of: the principle of languages, or is generality an indication of words or meanings? It does not result in any benefit from the point of view of the jurisprudential offshoot. However, we find scholars taking care of researching it; and even prolonging it sometimes; then they conclude this by declaring: This issue does not entail a jurisprudential benefit; but it was mentioned for cognitive exercise, and this is well known in many field of studies.
2. The call to remove this type of issue is the annihilation of this valuable benefit that is usually paid attention to in several Shariah related and non-related sciences, which many distinguished scholars of fundamentals of jurisprudence stipulated.
Some scholars have established many jurisprudential benefits on some of these issues; so there is no consensus on its non-usefulness, and this was shown in the applied study.
