الملخص
يتناول هذا البحث دراسة السمات المنهجية التي تعكس الاستقلال الاجتهادي للإمام المزني في كتابه المختصر، مسلطاً الضوء على خروجه عن اختيارات إمامه الشافعي في مسائل فقهية معينة.
ويسعى البحث عبر المنهج التحليلي إلى رصد بعض هذه المسائل، واستجلاء الأدلة التي اعتمد عليها المزني في بناء رأيه المستقل، مما يبرهن على ريادته كفقيه مجتهد داخل المدرسة الشافعية، وليس مجرد ناقل للمذهب.
وتكمن أهمية الدراسة في كشف آليات النقد والترجيح عند المزني، وبيان مدى تأثر الفكر الفقهي بمرونته المنهجية وقدرته على المحاكمة بين النصوص والأقوال.
Abstract
This research explores the methodological characteristics that reflect the independent legal reasoning of Imam Al-Muzani in his book Al-Mukhtasar. It highlights his departures from the preferences of his teacher, Imam Al-Shafi’i, regarding specific jurisprudential issues. Utilizing an analytical approach, the study aims to identify the issues and clarify the evidence Al-Muzani relied upon to construct his independent opinions, thereby demonstrating his leadership as a mujtahid jurist within the Shafi’i school rather than merely transmitting the school’s doctrine. The significance of this study lies in uncovering Al-Muzani’s mechanisms of critique and legal weighting while illustrating the impact of his methodological flexibility and ability to adjudicate between texts and various legal opinions on Islamic Jurisprudential thought.
