الملخص
يتناول هذا البحث دراسة تحليلية مقارنة لأحكام الانتحار في قانون جنايات جنوب نيجيريا بأحكام الفقه الإسلامي، ويهدف إلى تحليل المواد القانونية المتعلّقة بجريمة الانتحار في قانون جنايات جنوب نيجيريا وبيان الآثار المترتبّة عليها، مع تكييفها فقهياً وموازنتها بالأحكام الفقهية.
ويشتمل هذا البحث على مقدّمة، وتمهيد، وثلاثة مباحث؛ تناول الباحث في المبحث الأول: حكم الانتحار وعقوبته في قانون جنايات جنوب نيجيريا مقارنة بالفقه الإسلامي، وفي المبحث الثاني: حكم المساعدة على الانتحار وعقوبتها في قانون جنايات جنوب نيجيريا مقارنة بالفقه الإسلامي، وفي المبحث الثالث: حكم الشروع في الانتحار وعقوبته في قانون جنايات جنوب نيجيريا مقارنة بالفقه الإسلامي.
وتوصّل الباحث إلى عدد من النتائج، من أبرزها: أنّ مفهوم الانتحار في قانون نيجيريا يتّفق مع مفهومه في الفقه الإسلامي، غير أنّ الفقه الإسلامي لم يستعمل هذا المصطلح، وإنّما عبّر عنه بقولهم “قاتل نفسه”، كما تبيّن أنّ منظِّم قانون نيجيريا لم ينصّ على تجريم الانتحار صراحة، ولم يقرّر له عقوبة محدّدة، بخلاف الفقه الإسلامي الذي حرّم الانتحار تحريماً قاطعاً، وعدّها من كبائر الجرائم، ورتّب عليه أشدّ الوعيد والعقوبة الأخروية، وأنّ قانون جنايات جنوب نيجيريا يتّفق مع الفقه الإسلامي في تجريم المساعدة على الانتحار والشروع فيه، غير أنهما يختلفان في نوع العقوبة المقرّرة لكل منهما.
وأوصى الباحث بضرورة تعديل المواد القانونية المتعلّقة بجريمة الانتحار في قانون جنايات جنوب نيجيريا، وذلك بإدخال نصوص وعقوبات رادعة تُسهم في زجر الناس عن ارتكاب هذه الجريمة.
Abstract
This research presents an analytical comparative study of the rulings on suicide crime in the Criminal Code of Southern Nigeria and the rulings of Islamic jurisprudence. It aims to analyze the legal provisions related to the crime of suicide in the Criminal Code of Southern Nigeria and clarify their punishments, and examining their juristic interpretation and comparing them with Islamic legal rulings.
The study includes an introduction, a preface, and three sections: the first section discusses: the ruling on suicide and its punishment in the Criminal Code of Southern Nigeria compared with Islamic jurisprudence; the second addresses the ruling and punishment of assisting in committing suicide in the Criminal Code of Southern Nigeria compared with Islamic jurisprudence; and the third examines the ruling and punishment of attempted suicide in the context of the same comparison.
The researcher reached several conclusions, the most prominent of which are: that the concept of suicide in Nigerian law aligns with its concept in Islamic jurisprudence, although Islamic jurisprudence does not use this term explicitly, instead referring to it as “one who kills himself.” It also became clear that the drafters of Nigerian law did not explicitly criminalize suicide nor stipulate a specific punishment for it—unlike Islamic jurisprudence, which strictly prohibits suicide, considers it among the major sins, and assigns severe divine warnings and punishment in Hereafter, and that, the Criminal Code of Southern Nigeria agrees with Islamic jurisprudence in criminalizing assistance in suicide and attempted suicide, though they differ in the types of punishments prescribed.
The researcher recommends amending the legal provisions related to the crime of suicide in the Criminal Code of Southern Nigeria by introducing explicit and deterrent penalties that contribute to discouraging individuals from committing this act.
