الملخص
إن الإسلام يحرص على جلب المصالح للناس ودرء المفاسد عنهم، حتى في أمور العبادات، فلا يجوز للمسلم من أجل الحصول على ثواب العبادة إيذاء نفسه أو غيره، بل أباح الإسلام النطق بكلمة الكفر باللسان للحفاظ على النفس، فغيرها من باب أولى. وإن الله سبحانه وتعالى لا يكلف نفسًا إلا وسعها، وما جعل علينا في الدين من حرج، وإن تحديد العدد للحجاج في كل عام هو من هذا القبيل لدفع الضرر والمفاسد التي يتوقع حصولها على الحجاج فيما لو فتح الباب على مصراعيه، وهذا ما رأيناه عيانًا في حج عام 1445هـ، والعدد الكبير من الوفيات فيمن حج خارج هذا النطاق، وأن قاعدة درء المفاسد أولى من جلب المصالح من القواعد الفقهية المهمة التي ينبغي الانطلاق منها للحكم على هذه النازلة.
Abstract
Islam is profoundly committed to securing human interests (Masalih) and warding off harms (Mafasid), even in matters of worship (‘Ibadat). Consequently, a Muslim is not permitted to inflict harm upon themselves or others for the sake of attaining the rewards of worship. In fact, Islam has permitted the utterance of words of disbelief (Kufr) under duress to preserve life, which underscores that the preservation of life in other matters is even more paramount. Allah, the Exalted, does not burden a soul beyond its capacity, and He has not placed any undue hardship upon us in religion.
The annual regulation of the number of pilgrims (Hajj) falls under this principle; it is intended to avert the harms and damages that would predictably befall the pilgrims if the gates were left entirely open. This was clearly witnessed during the Hajj season of 1445 AH, given the high number of fatalities among those who performed Hajj outside the official regulatory frameworks. The legal maxim stating that “Warding off harms takes precedence over securing interests” (Dar’ al-Mafasidawla min Jalb al-Masalih) is one of the most important Islamic legal maxims (Al-Qawa’id al-Fiqhiyyah) that should be the starting point for ruling on this contemporary issue (Nazilah).
