الملخص
نعم الله تعالى على المسلمين كثيرة، منها رفع الحرج والعنت عنهم؛ فإذا كان الأمر أو النهي يوقع المكلف في حرج، فإن هذا الحرج يكون سبباً للتخفيف والترخيص؛ لتوافق الشريعة فطرة الإنسان وما يعتريه من نقص وضعف، وقد اهتم علماء الأصول بهذا وبينوا القواعد الأصولية المتعلقة بعوارض الأهلية، شروط إعمالها ومواطن تخلفها، وكان بيانهم جلياً واضحاً منضبطاً، على منهج الإسلام الوسط بلا تهاون ولا تشديد، وسارت بعض القوانين على هذا النهج، ومنها القانون الجنائي السوداني لعام 1991م.
احتوى هذا البحث على تعريف بالعقاب والقواعد الأصولية، ثم القواعد الأصولية المتعلقة بالمجنون والصبي والمكره والنائم، ثم القواعد الأصولية المتعلقة بالعلم والخطأ والتكليف بما لا يطاق، وتناول موقف الجنائي السوداني لعام 1991م من هذه المسائل السبعة، مع بيان المرجعية التي أخذ عنها القانون، وأيضًا أثر القواعد الأصولية في صياغته، ومدى التوافق بين الشريعة والقانون، وكان منهج البحث الاستقراء من القواعد الأصولية، ونصوص القانون محل البحث، ثم التحليل الأصولي والقانوني لمواضع الاستقراء.
من أهم النتائج التي خرج بها البحث، ظهور أثر مصادر الاستدلال الشرعية في القانون محل البحث، واتفق القانون مع الشريعة في أن الخطأ مرفوع، والعقل شرط في التكليف وتحمل المسؤولية الجنائية، كما أن الصِغر والإكراه والجنون والنوم من موانع المسؤولية الجنائية لتخلف شرط الإدراك والاختيار، وجاء في التوصيات، استكمال دراسة القواعد الأصولية الأخرى، وبيان علاقتها بالقانون محل البحث والقوانين الأخرى، في مسائل متنوعة منها مقاصد الشريعة وخاصة الضروريات وافراد كل واحدة منها ببحث.
Abstract
Fundamentals of Jurisprudence that affecting punishment In the Sudanese
Criminal Law of 1991
This study investigates the integration of principles from Islamic legal theory the Sudanese Criminal Law of 1991, focusing on provisions that preclude or negate criminal punishment. It underscores a foundational tenet of Sharia: the removal of undue hardship and the granting of legal concessions, which aligns divine law with human nature and inherent limitations.
The research analytically examines seven key jurisprudential principles affecting criminal liability: the legal status of the insane, the minor, the coerced, and the sleeper, alongside doctrines concerning requisite legal knowledge, error, and supererogatory. Using an inductive and analytical methodology, it traces the codification of these classical principles within the modern statutory framework of the Law.
The findings reveal substantial alignment between Sharia and the Sudanese Criminal Law. The law incorporates the Islamic principle that sound mind is a prerequisite for legal responsibility, thereby recognizing insanity, minority, coercion, and sleep as impediments to criminal liability due to the absence of intentionality and free will. It also upholds the principle that liability for innocent error is generally waived, demonstrating a clear derivation from Islamic legal sources. The study concludes by recommending further research into other jurisprudential principles and their application across legal systems. It particularly advocates for dedicated studies on the “Objectives of Sharia” especially the preservation of the five essentials—and their potential role in shaping progressive criminal legislation.
