الملخص
يتناول هذا البحث مسألة التعزير من غير معصية دراسةً تأصيليةً استقرائية، وذلك من خلال بيان أقوال الفقهاء في حكمه والترجيح بينها، واستقراء صوره في التراث الفقهي الإسلامي، واستخلاص ضوابطه الشرعية، والكشف عن موقف الأنظمة السعودية منه.
وقد خلص البحث إلى أن التعريف الأوفق للتعزير هو أنه «عقوبة غير مقدّرة شرعًا»، لاتساعه ليشمل التعزير على المعصية وغيرها، وأن الفقهاء اختلفوا في تكييف التعزير من غير معصية بين من يعدُّه عقوبةً تعزيريةً، ومن يكيِّفه على أنه تدبير احترازي وسياسة شرعية، وأن الخلاف بين القولين في التكييف لا في التطبيق، وأن الراجح مشروعية التعزير من غير معصية لتعدد الأدلة الدالة عليه من السنة وآثار الصحابة.
وأبرز صور هذا التعزير: الحبس في التهمة، والنفي أو الحبس خشية الفتنة، وحبس مدعي الإعسار استظهاراً لحاله، وتعزير غير المكلف كالصبي والمجنون، والمنع من السفر لمصلحة معتبرة. وقد أحاط البحث هذا الباب بثمانية ضوابط تصونه من الانزلاق إلى الظلم، أبرزها: اشتراط المصلحة الراجحة، وتعذّر البديل الأخف، والتناسب مع المقصود، وصدوره ممن له ولاية، ومراعاة حال المعزَّر، وغلبة الظن، وتخفيف الآثار والتعويض عند الخطأ، وانتفاء المفسدة الأعظم. وقد ثبت أن المنظم السعودي أخذ بجملة من هذه الصور وأحاطها بضمانات تكفل حقوق من تقع عليه.
Abstract
This research examines the issue of discretionary punishment (ta’zir) in the absence of a religious offense, through a foundational and inductive study. It explores the opinions of Islamic jurists on its ruling, weighs their arguments, traces its forms in classical Islamic jurisprudence, derives its governing principles, and examines its reception in Saudi law.
The research concludes that the most appropriate definition of ta’zir is “a legally unspecified penalty,” broad enough to encompass punishment for both offenses and non-offenses. Jurists differed in classifying ta’zir without a religious offense: some treated it as a disciplinary punishment, while others regarded it as a precautionary measure or legal policy. This disagreement is terminological rather than practical, and the preponderant view is that such punishment is lawful, supported by multiple prophetic traditions and the practices of the Companions.
Its most prominent forms include: preventive detention, exile or confinement to avert civil strife, imprisonment of an insolvent debtor pending investigation, discipline of the non-legally-responsible such as children and the mentally ill, and travel bans for legitimate interests. The research identifies eight governing conditions to prevent abuse, including: a preponderant benefit, unavailability of a lighter alternative, proportionality, competent authority, consideration of the subject’s character, strength of suspicion, mitigation of effects with compensation for error, and the absence of a greater harm. Saudi regulations have incorporated several of these forms with safeguards protecting those subject to them.
