الملخص
هذه الدراسة تناولت اهتمام المملكة العربية السعودية في إطار التشريعات والتنظيمات الدولية بالبيانات والبيانات الضخمة، متخذةً من “نظام حماية البيانات الشخصية” (PDPL) نموذجاً تطبيقياً للتحليل. وغاية الدراسة بيان مدى فاعلية هذه الأطر في تحقيق الحوكمة المؤسسية والسيادة الرقمية، داخل المملكة العربية السعودية ومواءمتها مع المعايير الدولية للتنمية المستدامة (UN SDGs). وعمل الباحث على المنهج الوصفي التحليلي لوصف ظاهرة البيانات الضخمة وأبعادها التنموية وتحليل النصوص المتعلقة بذلك. ثم المنهج المقارن لربط منظومة السياسات الوطنية السعودية بالتوجهات والمعايير الدولية لبيان مدى مواءمة التشريع السعودي بالاتفاقيات والممارسات الدولية.
وخلاصة القول توصلت الدراسة إلى أن التشريع السعودي توازن في صياغة النظم والقوانين المحققة للحقوق اللصيقة بالشخصية الإنسانية المستمدة من الشريعة الإسلامية، ومن جانب آخر توظيف البيانات كمورد اقتصادي تنموي مستدام يساعد في الحد من الهدر الرقمي وحماية الأمن القومي من خلال ضوابط نقل البيانات خارج الحدود.
Abstract
This study examines the interest of the Kingdom of Saudi Arabia in data and Big Data within international legislative and regulatory frameworks, utilizing the “Personal Data Protection Law” (PDPL) as an empirical paradigm for analysis. The objective of this study is to demonstrate the effectiveness of these frameworks in achieving institutional governance and digital sovereignty within Saudi Arabia, and their alignment with the United Nations Sustainable Development Goals (UN SDGs). The researcher employs a descriptive-analytical approach to delineate the phenomenon of Big Data and its developmental dimensions, while analyzing the relevant statutory provisions. Furthermore, a comparative approach is applied to interconnect Saudi national policies with global trends and standards, illustrating the alignment of Saudi legislation with international conventions and best practices. The study concludes that Saudi legislation has successfully maintained a meticulous balance; on one hand, it formulates laws and regulations that guarantee rights inherent to the human personality derived from Islamic Sharia, and on the other hand, it harnesses data as a sustainable economic and developmental resource that mitigates digital waste and safeguards national security through stringent cross-border data transfer controls.
