Abstract
This study examines the hadiths concerning testimony given before being formally requested, foremost among them the marfūʿ hadith of Zayd ibn Khālid al-Juhanī (may Allah be pleased with him): “Shall I not tell you who the best of witnesses are? The one who gives his testimony before he is asked for it,” together with the apparently contrasting hadith of ʿImrān ibn Ḥuṣayn (may Allah be pleased with him), which censures people who “give testimony without being asked to testify.” The study seeks to critically examine the chains of transmission and textual variants of the relevant hadiths, identify the approaches adopted by hadith scholars and jurists in reconciling them, determine the juristic ruling on volunteering testimony before it is requested, and compare this with the authority granted to the court under Article 72 (3) of the Saudi Law of Evidence to summon, on its own motion, any person whose testimony it deems necessary for ascertaining the truth. The study concludes that the apparent conflict among these texts is only superficial and that volunteering testimony is neither commendable nor blameworthy merely because it precedes a formal request. Rather, its ruling varies according to the nature of the right involved, the right-holder’s knowledge of the testimony, the risk of the right being lost, and the likelihood of suspicion attaching to the witness. It further concludes that the situation contemplated by Article 72 (3) does not correspond exactly to that of a witness volunteering testimony, since the initiative in the statutory provision originates from the court after litigation has commenced. Nevertheless, the provision converges with the juristic understanding of the hadiths in the objective of ascertaining the truth and preventing rights from being lost, while preserving procedural safeguards and the parties’ rights to examine and challenge the witness.
