الملخص
عنوان هذا البحث (تخريج نوازل مختارة في الحج على الفروع الفقهية في المذهب الشافعي: دراسة تطبيقية)، يهدف البحث إلى بيان أثر التخريج على الفروع الفقهية في استنباط أحكام النوازل المعاصرة المتعلقة بالحج في المذهب الشافعي، وإبراز صلاحية الفروع المذهبية لتنزيل الأحكام على الوقائع المستجدة، وبيان الصلة بين الفقه الموروث والاجتهاد الفقهي المعاصر، واعتمد الباحث المنهج الاستقرائي والتحليلي، مع الإفادة من المنهج المقارن عند عرض أقوال الفقهاء المعاصرين، وتناول خمسة نوازل مختارة، هي: الطواف، والسعي، والوقوف بعرفة، والرمي، والإحرام، من خلال تخريجها على الفروع المعتمدة في المذهب الشافعي، ثم مقارنتها باجتهادات الفقهاء المعاصرين، وانتهى البحث إلى أن التخريج على الفروع يمثل مسلكًا أصيلًا في معالجة النوازل، وأن أكثر المسائل المدروسة أمكن تخريجها على فروع مذهبية معتمدة، مع موافقة نتائج التخريج في غالبها لما انتهى إليه جمهور الفقهاء المعاصرين، وأن تحقيق المناط وتمييز الفارق المؤثر يعدان أساس سلامة التخريج وصحة إلحاق النوازل بالفروع الفقهية.
Abstract
Title: Takhrīj of Selected Contemporary Hajj Issues Based on Juristic Branches in the Shāfiʿī School: An Applied Study.
This study examines the impact of takhrīj based on juristic branches in deriving rulings for selected contemporary Hajj issues within the Shāfiʿī school. It seeks to demonstrate the applicability of established juristic branches to newly emerging cases and to highlight the relationship between the classical juristic heritage and contemporary legal reasoning. The study employs the inductive and analytical methods, while drawing on the comparative method in presenting and discussing the opinions of contemporary jurists. It investigates five selected contemporary Hajj issues—ṭawāf, saʿy, standing at ʿArafah, stoning the Jamarāt, and iḥrām—by relating each issue to its corresponding juristic branches in the authoritative Shāfiʿī legal tradition and comparing the resulting takhrīj with the views of contemporary jurists. The study concludes that takhrīj based on juristic branches constitutes an established juristic methodology for addressing contemporary legal issues. It further finds that most of the issues examined can be validly derived from recognized Shāfiʿī juristic branches and that the outcomes of such takhrīj are, in most cases, consistent with the opinions of the majority of contemporary jurists. The study also concludes that accurate taḥqīq al-manāṭ (verification of the effective legal cause) and distinguishing legally relevant differences constitute the foundation of sound takhrīj and the correct application of juristic branches to contemporary issues
