الملخص
هذا البحث يُعنى بدراسة تخريج الأصول من الفروع الذي يعتبر أحد أنواع التخريج الأصولي، ووقع اختياري في دراسة هذا النوع من التخريج من خلال (كتاب كشف الأسرار للإمام عبد العزيز البخاري) الذي يعدّ من الكتب الأصولية التي تمثل منهج الفقهاء في ذكر القواعد الأصولية المخرّجة من خلال الفروع المنقولة عن الأئمة. وتهدف هذه الدراسة إلى بيان مفهوم تخريج الأصول من الفروع، ومنهج البخاري في التخريج، وذكر شيء من ترجمته، ودراسة بعض النماذج من القواعد المخرّجة على الفروع. ومن أهم ما توصلت إليه من النتائج أن الأصل المخرّج من الفرع المنقول قد يتفق علماء الحنفية على تعيينه، وقد يختلفون في ذلك، وأن منهج البخاري في عرض القواعد المخرّجة متنوعة.
Abstract
This research examines the derivation of jurisprudential principles from substantive legal rulings (Takhrij al-Usul min al-Furu), which is considered a distinct branch of Usul derivation (al-Takhrij al-Usuli). This study explores this specific methodology through the Kashf al-Asrar treatise by Imam Abdul-Aziz al-Bukhari. This book represents a foundational text of the jurists’ approach (Manhaj al-Fuqaha), which articulates jurisprudential principles extracted from the specific legal rulings transmitted from the early Imams. The study aims to clarify the concept of Takhrij al-Usul min al-Furu, analyze al-Bukhari’s methodology in derivation, provide a brief biography of the author, and examine selected models of principles derived from substantive legal rulings. Among the most significant findings of this study is that Hanafi scholars may either reach a consensus on identifying a specific derived principle from a transmitted ruling, or they may differ. Furthermore, the study concludes that al-Bukhari employs a diverse and multi-faceted approach in presenting these derived principles.
