الملخص
يتناول هذا البحث موضوع العلاقة بين المذاهب الفقهية والهوية الإسلامية الجامعة في ظل التحديات التي فرضتها العولمة الثقافية، حيث يسعى البحث إلى بيان أن التعدد المذهبي ليس مظهراً للفُرقة، بل هو مظهر من مظاهر الرحمة والسعة التي اتسمت بها الشريعة الإسلامية، متى ما فُهم في إطاره الشرعي، وأُدير بروح الانتماء للأمة الإسلامية لا للمذهب.
اعتمد البحث المنهج الوصفي التحليلي، مستعرضاً الإطار النظري لمفاهيم المذهب والهوية والعولمة، ثم تطرّق إلى الأبعاد التاريخية والثقافية لنشأة المذاهب، وخصائص الهوية الإسلامية، ومظاهر التأثير السلبي للعولمة على الثقافة الإسلامية والانتماء الديني.
كما تناول البحث مظاهر سوء التعامل مع التعدد المذهبي، كالتعصب، وإقصاء المخالف، ورفع الخلافيات إلى مستوى العقيدة، ثم ختم بمحور تطبيقي يعرض مبادئ عملية في التعامل مع الخلاف، ومبادرات لتعزيز الهوية الجامعة من خلال توظيف التعدد الفقهي في ترسيخ الانتماء وتفعيل فقه التعايش.
وقد توصّل البحث إلى نتائج من أبرزها: أن تراجع فقه الخلاف في المؤسسات التعليمية والدعوية، وغياب التربية على أدب الخلاف، من أبرز أسباب تنامي النزعة الطائفية وتفكك الانتماء الجماعي.
كما أوصى البحث بضرورة إدماج فقه الخلاف في المناهج الشرعية، وتأهيل الكوادر التربوية والدعوية على ثقافة التعدد، وإطلاق برامج إعلامية ومجتمعية تُبرز الجوامع وتُحاصر مظاهر التشظي والانغلاق.
ويأمل الباحث أن يسهم هذا الجهد اليسير في إحياء روح التراحم والتكامل الفقهي، بما يعيد للتنوع الفقهي مكانته كأداة لبناء وحدة معرفية تتسع للاجتهاد، في زمن تتكاثر فيه موجات التشويش والتفكيك المتعلق بالهوية، وأن يكون لبنة في مشروع وعيٍ شرعيٍّ وثقافيٍّ يعيد للأمة الإسلامية توازنها بين الأصالة والمعاصرة.
Abstract
This study explores the relationship between Islamic legal schools (madhāhib) and the unified Islamic identity considering the cultural challenges imposed by globalization. It aims to demonstrate that jurisprudential plurality is not a cause of division, but rather a manifestation of the mercy and expansiveness of Islamic law—provided it is understood within its proper framework and governed by a spirit of allegiance to the Ummah rather than to a specific school of thought.
The research adopts a descriptive and analytical methodology, beginning with the theoretical foundations of madhhab, identity, and globalization. It then traces the historical and cultural evolution of the legal schools, the features of Islamic identity, and the negative impacts of globalization on Islamic culture and religious affiliation. The study also analyzes the consequences of mismanaging madhhab diversity, such as sectarian fanaticism, exclusion of differing opinions, and the elevation of secondary jurisprudential disagreements to the level of creed. The study concludes with a practical section outlining foundational principles for managing scholarly disagreement and proposing initiatives to strengthen unified identity through jurisprudential diversity.
The findings indicate that the decline of “Fiqh al-Akhila” (jurisprudence of disagreement) in educational and religious institutions, along with the lack of training in the ethics of difference, are among the primary causes of sectarian attitudes and weakened collective belonging. Research recommends integrating this jurisprudence into curricula, training preachers and educators in pluralistic values, and launching media and community programs that emphasize common ground and counter divisive tendencies.
It is hoped that this study contributes to reviving the spirit of mutual respect across Islamic legal schools, fostering unity in an era of increasing ideological fragmentation, and promoting a balanced scholarly and cultural awareness that reconciles authenticity with openness.
