الملخص
يتناول هذا البحث علمَ الأخلاقيات الطبية (Bioethics) بالدراسة الشرعية التحليلية النقدية، من حيث نشأته وأصوله ومصادره ومعياريته، ومقارنتها بأصول الشريعة ومنطلقاتها ومعياريتها. ويهدف إلى تحليل المفاهيم والمقولات المؤسِّسة لهذا العلم، ومقارنتها بالأصول والمبادئ الشرعية للكشف عن مواضع الاتفاق والافتراق في المنطلقات والمناهج، ونقدِ الأسس الغربية التي قام عليها، وصولًا إلى تأصيل موقف شرعي منه، واقتراح ملامحَ لتفعيل دور متخصصي الشريعة في معالجة الإشكالات الطبية المعاصرة. واعتمد المنهجَ التحليلي المقارن والنقدي. وخلص البحث إلى أنّ علم الأخلاقيات الطبية يفتقر إلى أساس معياري ثابت، ويعاني اضطرابًا منهجيًّا نتيجةَ تعدد الفلسفات وغياب المرجعية الحاكمة؛ بينما تملك الشريعة منظومةً متكاملة من النصوص والكليات والمقاصد تضبط هذا المجال وتوجّهه، وتجمع بين النظرية الكلية وتفصيل الأحكام. وأنّ الموقف الشرعي يقوم على الإفادة من الجوانب الوصفية والإجرائية غير المعيارية تحت ضابطٍ شرعي، مع رفض إحلال مرجعيتها محلَّ الوحي في تقرير القيم. وأوصى البحث بتأهيل متخصصي الشريعة تأهيلًا يمكّنهم من الانخراط في المؤسسات واللجان الأخلاقية الطبية، وتطويرِ التنظير الشرعي في هذا الميدان، وربطِ الجهود الأكاديمية بالواقع الطبي.
Abstract
This study offers a critical, analytical Sharīʿah examination of medical ethics (bioethics) — its emergence, foundations, sources, and normativity — compared with those of Islamic law. It analyzes the discipline’s founding concepts, identifies their agreement with and divergence from Sharīʿah principles, critiques its Western bases, establishes a Sharīʿah position toward it, and proposes ways to activate the role of Sharīʿah specialists in contemporary medical issues. Using an analytical, comparative, and critical method, it concludes that medical ethics lacks a stable normative foundation and suffers methodological instability from competing philosophies and the absence of a governing authority, whereas Sharīʿah provides an integrated system of texts, universals, and higher objectives (maqāṣid) that regulates the field and unites holistic theory with detailed rulings. The Sharīʿah position draws on descriptive and procedural aspects under Sharīʿah control while rejecting any substitution of their authority for revelation. It recommends qualifying Sharīʿah specialists for medical-ethics institutions and committees, developing Sharīʿah theorization, and linking academic work to medical practice.
