الملخص
عنوان البحث: أثر الخيار في انتقال الملك ونفوذ التصرفات المالية في الفقه الشافعي (من اللوحة 255 إلى اللوحة 260 من كتاب المطلب العالي لابن الرفعة دراسة وتحقيقاً).
موضوع البحث: يسعى هذا البحث إلى إبراز جانب نفيس من التراث الفقهي الشافعي عبر دراسة وتحقيق جزئية دقيقة من موسوعة “المطلب العالي” للإمام ابن الرفعة (ت: 710هـ). وقد انتظمت خطة العمل في مقدمة، وتمهيد، وقسمين رئيسين، وفهارس؛ خُصص الأول منهما للدراسة النظرية التي تناولت سيرة الإمامين الغزالي وابن الرفعة، مع تسليط الضوء على القيمة العلمية لكتابي “الوسيط” و”المطلب العالي” ومنهج مؤلفيهما.
أما القسم الثاني فقد عُني بالنص المحقق، حيث تركزت المادة العلمية فيه على أثر الخيار في انتقال الملكية ونفوذ التصرفات المالية في المبيع، وهي من المسائل الدقيقة في فقه المعاملات التي تشتد إليها حاجة الناس؛ لتعلقها بتعاملاتهم المالية. وقد قام التحقيق على نسخة خطية محفوظة بمكتبة أحمد الثالث بتركيا وجعلتها أصلًا للتحقيق، كما توجد نسخة أخرى بدار الكتب المصرية إلا أني لم أتمكن من الحصول عليها عند إعداد هذا البحث.
المنهج المتبع: وقد اعتمدت الدراسة المنهج الوصفي في القسم الدراسي، والمنهج التحقيقي في إخراج النص، من خلال نسخ المخطوط وضبطه وتوثيق نصوصه، وتخريج الأحاديث والآثار، وتوثيق النقول الفقهية، وشرح الألفاظ الغريبة، والتعريف بالأعلام والأماكن، وإعداد الفهارس.
فالله أسأل؛ أن يهدينا ويسددنا، وأن يرزقنا الإخلاص في القول والعمل.

Abstract
Title: The Effect of Option (Khiyār) on the Transfer of Ownership and the Validity of Financial Dispositions in Shāfiʿī Jurisprudence (From Folios 255–260 of al-Maṭlab al-ʿĀlī by Ibn al-Rifʿah: A Study and Critical Edition)
This study aims to highlight a valuable aspect of the Shāfiʿī juristic heritage through a critical study and edition of a selected passage from the encyclopedic work al-Maṭlab al-ʿĀlī by Imām Ibn al-Rifʿah (d. 710 AH). The research is structured into an introduction, a preliminary section, two main parts, and indices. The first part is devoted to the theoretical study, which examines the biographies of Imām al-Ghazālī and Ibn al-Rifʿah, while also shedding light on the scholarly significance of al-Wasīṭ and al-Maṭlab al-ʿĀlī, as well as the methodological approaches adopted by their authors.
The second part focuses on the critical edition of the text, centering on the issue of the effect of contractual options (khiyār) on the transfer of ownership and the validity of financial transactions concerning the sold object. This topic represents one of the more nuanced and practically significant discussions in Islamic commercial jurisprudence, given its direct relevance to everyday financial dealings. The edition is primarily based on a manuscript preserved in the Ahmed III Library in Turkey, which has been adopted as the base text. Another manuscript copy is known to exist in Dār al-Kutub al-Miṣriyyah; however, it was not accessible during the preparation of this research.
Methodologically, the study employs a descriptive approach in the analytical section and a critical editing method in preparing the text. This includes careful transcription of the manuscript, textual verification, documentation of juristic sources, authentication of ḥadīth and reports, explanation of unfamiliar terms, identification of notable figures and places, and the preparation of detailed indices.
The study concludes by seeking divine guidance and sincerity in both word and deed, and invoking blessings upon the Prophet Muḥammad, his family, and his companions.
