الملخص
يتناول هذا البحث دراسة البعدين النفسي والاجتماعي في قوله تعالى: ﴿وَإِذَا حَضَرَ الْقِسْمَةَ أُولُوا الْقُرْبَى وَالْيَتَامَى وَالْمَسَاكِينُ فَارْزُقُوهُمْ مِنْهُ وَقُولُوا لَهُمْ قَوْلًا مَعْرُوفًا﴾ (النساء: 8)، يهدف البحث إلى إبراز عناية الشريعة الإسلامية بالفئات الضعيفة، وبيان المعنى الإجمالي والمقاصد التكافلية للآية الكريمة. اعتمد الباحث على المنهج التحليلي والموضوعي والاستقرائي لدراسة مفردات الآية، ودلالاتها البلاغية، ومناسبتها لما قبلها، كما ناقش البحث الأحكام الفقهية المتعلقة بالآية، ولا سيما الخلاف في تحديد المخاطب، وحكم الأمر فيها (الوجوب أم الاستحباب)، ومسألة النسخ والإحكام.
وتوصل البحث إلى جملة من النتائج، أبرزها: أن الآية محكمة غير منسوخة، وأن الأمر فيها محمول على الندب المؤكد جمعاً بين الأدلة وتحقيقاً لمقاصد الشريعة، كما أظهر البحث التوازن الدقيق في الخطاب القرآني الذي يجمع بين العدالة التشريعية والمواساة الاجتماعية، من خلال إشراك الحاضرين من غير الورثة بشيء من المال أو الكلمة الطيبة لجبر خواطرهم. وختم البحث بتوصيات تؤكد على أهمية تفعيل البعد الاجتماعي واستلهام الهدايات القرآنية في فقه المعاملات المالية.
Abstract
This research explores the psychological and social dimensions in the Almighty’s saying: “And when [other] relatives and orphans and the needy are present at the [time of] division, then provide for them [something] out of the estate and speak to them words of appropriate kindness” (An-Nisa: 8). The study aims to highlight Islamic Sharia’s care for vulnerable groups and explain the verse’s general meaning and its objectives regarding social solidarity. The researcher utilized the analytical, objective, and inductive methodologies to examine the verse’s vocabulary, its rhetorical implications, and its contextual relevance to the preceding verses. Furthermore, the research discussed the jurisprudential rulings related to the verse, specifically the scholarly disagreement regarding the addressee, the ruling of the command within it (obligation versus recommendation), and the issue of abrogation and decisiveness (Naskh and Ihkam). The study concluded with several key findings, most notably that the verse is decisive (Muhkam) and not abrogated, and that the command within it denotes a strong recommendation (Mandub), reconciling the evidences and achieving the objectives of Sharia. Additionally, the research demonstrated the delicate balance in the Quranic discourse, which combines legislative justice with social consolation by sharing a portion of the wealth or offering kind words to non-inheriting attendees to comfort them. The research concluded with recommendations emphasizing the importance of activating the social dimension and drawing inspiration from Quranic guidance in the jurisprudence of financial transactions.
