الملخص
يتناول هذا البحث التأصيل الفقهي للإشراف الأكاديمي في ضوء القواعد الفقهية الكلّية، وقد اعتمد على المناهج الاستقرائي والتحليلي والتأصيلي. جاء البحث في ثلاثة مباحث: خُصّص الأوّل لبيان مفهوم الإشراف الأكاديمي وأنواعه ومنزلة القواعد الكلّية في تأصيل النوازل المعاصرة، وتناول الثاني تطبيقات القواعد الكبرى الخمس على الإشراف الأكاديمي وهي: الأمور بمقاصدها، واليقين لا يزول بالشكّ، والمشقّة تجلب التيسير، ولا ضرر ولا ضرار، والعادة محكَّمة، وعالج الثالث تطبيقات ثلاث قواعد فرعية هي: التصرّف على الرعية منوط بالمصلحة، ودرء المفاسد مقدَّم على جلب المصالح، وإذا تعارضت مفسدتان رُوعي أعظمهما ضررًا بارتكاب أخفّهما. وقد خلص البحث إلى أنّ القواعد الفقهية الكلّية تُوفّر إطارًا شرعيًّا محكمًا لضبط العلاقة الإشرافية وحفظ حقوق أطرافها.
Abstract
This study examines the jurisprudential grounding of academic supervision in light of the universal legal maxims (al-qawa’id al-fiqhiyyah al-kulliyyah). The study employs inductive, analytical, and foundational approaches. It comprises three main sections: the first establishes the conceptual framework by defining academic supervision and the status of universal maxims in addressing contemporary issues; the second applies the five major maxims to academic supervision, namely: matters are judged by their intentions, certainty is not overruled by doubt, hardship begets facilitation, no harm and no reciprocal harm, and custom is authoritative; and the third applies three subsidiary maxims: authority over subjects is contingent upon their welfare, preventing harm takes precedence over securing benefit, and when two harms conflict the greater is averted by committing the lesser. The study concludes that the universal legal maxims provide a robust jurisprudential framework for regulating the supervisory relationship and safeguarding the rights of all parties involved.
