الملخص
يعنى هذا البحث ببيان أثر تضيق الوقت في المسائل الأصولية، وقد اعتمد الباحث على المنهج الاستقرائي التحليلي، وعقد تمهيدًا وسبعة مطالب، التمهيد: في تعريف الوقت، وأقسام الوقت من حيث الاتساع والضيق. وجاءت المطالب كالتالي: الأول: أثر تضيق الوقت في الواجب، الثاني: أثر ضيق الوقت في لزوم الأداء. الثالث: أثر ضيق الوقت في دلالة الأمر بالشيء على النهي عن ضده، الرابع: أثر ضيق الوقت عن البحث عن مخصص في العمل بالعموم، الخامس: أثر ضيق الوقت في وجوب البيان، السادس: أثر تضيق الوقت في الاجتهاد، السابع: أثر ضيق الوقت في جواز تقليد المجتهد لمجتهد آخر.
ثم خلص الباحث إلى أن وصف الوقت بالاتساع والضيق هو من أكثر الأوصاف التي كثر كلام الأصوليين فيها، وأن لتضيق الوقت أثرًا في كثير من المسائل الأصولية.
كما انتهى الباحث إلى أهمية الاعتناء بأثر القواعد الأصولية، وتطبيقاتها الفقهية.
Abstract
This study examines the impact of time constraint (narrowness of time) on issues in Uṣūl al-Fiqh (Islamic legal theory). The researcher adopts an inductive-analytical methodology and structures the paper with an introduction and seven main sections. The introduction addresses the definition of time and its classifications in terms of expansiveness and constriction. The subsequent sections are organized as follows:
The impact of time constraint on obligation (wājib).
The impact of limited time on the necessity of performance.
The effect of time constraint on whether a command implies prohibition of its opposite.
The impact of limited time for investigating a specifying qualifier on acting upon general texts.
The effect of time constraint on the obligation of clarification.
The impact of time constraint on ijtihād.
The effect of limited time on the permissibility of a mujtahid’s adherence to another mujtahid.
The study concludes that describing time as expansive or constrained is among the most extensively discussed characterizations in the writings of legal theorists, and that time constraint has significant implications across numerous foundational legal issues.
The research further underscores the importance of careful attention to the implications of uṣūlī principles and their juristic applications.
