الملخص
عنوان هذا البحث: تخريج الفروع على الفروع عند الشافعية كتاب السَلَم أنموذجاً، يهدف إلى إبراز منهج الاستدلال عند الشافعية، وكيفية تعامل فقهاء المذهب مع الفروع المتشابهة وإلحاقها بما يناسبها من نظائر، كما أنه يُبرز سعة المذهب الشافعي ومرونته في استيعاب النوازل والمسائل المستجدة.
وقد قسمته إلى مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة. المقدمة: وتشمل أهمية الموضوع، وأسباب اختياره، وأهداف البحث، والدراسات السابقة، ومشكلة البحث، ومنهج البحث، وخطة البحث. التمهيد: وفيه مطلبان: تعريف التخريج. وأصول التخريج.
ثم المبحث الأول: في حكم التخريج عند الشافعية، ونسبته إلى الإمام الشافعي، ويأتي المبحث الثاني في أصحاب التخريج من الأئمة الشافعية، والشروط الواجب توفرها في المخرج. ثم المبحث الثالث: في تخريج الفروع على الفروع في كتاب السلم.
ومن أهم نتائج البحث أن التخريج لا يكون لأي أحد، بل إن أصحاب التخريج عند الشافعية هم المجتهدون المقيدون بمذهب الشافعي، المتمكنون من التخريج، وإلحاقِ ما ليس بمنصوص في مذهب إمامهم بأصول مذهبه، وقواعده، ونصوصه، ويُطلق عليهم أصحاب الوجوه.
Abstract
The title of this research: “The Graduation of Branches from Branches in the Shafi’i School of Thought, Using the Book of Salam as a Model.” It aims to highlight the Shafi’i school’s method of reasoning and how the school’s jurists deal with similar branches and attach appropriate parallels. It also highlights the breadth and flexibility of the Shafi’i school of thought in accommodating emerging issues and developments.
I divided it into an introduction, a preface, three chapters, and a conclusion. The introduction: includes the importance of the topic, the reasons for choosing it, the research objectives, previous studies, the research problem, the research methodology, and the research plan. The preface: includes two sections: defining graduation and the principles of graduation.
The first section deals with the ruling on Takhreej according to the Shafi’i school of thought, and its attribution to Imam al-Shafi’i. The second section deals with the Shafi’i imams who adopted Takhreej and the conditions that must be met by the Takhreej. The third section deals with Takhreej of branches upon branches in the Book of Salam.
One of the most important findings of the research is that the authoritative interpretation of hadiths is not limited to just anyone. Rather, the Shafi’i scholars are those who are qualified to interpret hadiths and to incorporate what is not explicitly stated in their imam’s school of thought into the principles, rules, and texts of his school of thought. They are called the “People of the Faces.
