الملخص
تأتي أهمية هذا البحث؛ لبيان أهمية القواعد الفقهية في فهم المستجدات الفقهية الطبية، وأنه يتناول قاعدة مهمة من القواعد الفقهية التي تُعدُّ من أهم قواعد السياسة الشرعية وربطها بالجانب الفقهي التطبيقي، يهدف هذا البحث إلى: بیان شمول الشريعة لأحكام السياسة الشرعية من خلال القواعد الفقهية ومعالجتها للمستجدات، توضيح واجب أصحاب الولايات العامة المتعددة في رعايتهم لمن هو تحت أمرهم، وإلى إثراء المكتبة الفقهية بالتطبيقات المعاصرة للقواعد الشرعية، انتظمت خطة البحث في مقدمة، ومبحثين، وخاتمة، على النحو التالي: المبحث الأول: معنى القاعدة، صيغها، أدلتها، وفيه ثلاثة مطالب، المطلب الأول: معنى القاعدة لغة واصطلاحا، المطلب الثاني: صيغ القاعدة وألفاظها عند الفقهاء، المطلب الثالث: أدلة مشروعية القاعدة، المبحث الثاني: تطبيقات معاصرة للقاعدة في المجال الطبي وفيه ثلاثة مطالب، المطلب الأول: الفحص الطبي قبل الزواج، المطلب الثاني: أخذ اللقاحات (التطعيمات)، المطلب الثالث: استخدام البصمة الوراثية لتأكد من النسب الثابت، المطلب الرابع: الحجر الصحي.
Abstract
The importance of this research lies in: To demonstrate the importance of jurisprudential rules in understanding medical jurisprudential developments, and It addresses an important rule of jurisprudence, which is considered one of the most important rules of Islamic politics, and links it to the applied jurisprudential aspect. this research aims to: demonstrate the comprehensiveness of Sharia law regarding the provisions of Sharia policy through jurisprudential rules and their treatment of developments; and clarify the duty of those with multiple general mandates to care for those under their control; and enrich the jurisprudential library with contemporary applications of Sharia rules. The research plan is organized into an introduction, two sections, and a conclusion, as follows: Section One: The meaning of the rule, its formulations, and its evidence. It includes three topics. Chapter One: The meaning of the rule linguistically and technically. Chapter Two: The formulations and expressions of the rule among jurists. Chapter Three: Evidence of the rule’s legitimacy. Sections Two: Contemporary applications of the rule in the medical field. It includes three topics. Chapter One: Premarital medical examination. Chapter Two: Taking Vaccinations. Chapter Three: The use of genetic fingerprinting to confirm established lineage. Chapter Four: Quarantine.
