الملخص
يتناول هذا البحث بيان حقيقة النسخ في القرآن الكريم من حيث تعريفه، والمراحل التي مرَّ بها مصطلح النسخ وأركانه، وأنواعه، وطرق معرفته، وبيان الفرق بينه وبين مفاهيم مشابهة كالتخصيص والبَداء. كما يسعى لتوضيح الحكمة الشرعية من النسخ مع عرض أمثلة تطبيقية له في النصوص القرآنية. وقد اعتمد الباحث على المنهجين الاستقرائي والوصفي. وقد خلصت الدراسة إلى أنَّ حقيقة النسخ هي رفع حكم شرعي بدليل شرعي آخر، وأنَّ للنَّسخ أركانًا واضحة تشمل: الناسخ، والمنسوخ، والمنسوخ به، والمنسوخ عنه. كما أن التفرقة بين النسخ والتخصيص والبَداء ضرورية لفهم الأحكام ومراحل تطورها. ومن خلال تحليل الأمثلة القرآنية، يتبيّن أن النسخ أداة تشريعية ارتبطت بالمصلحة والتدرج، وهي تدل على حكمة الله تعالى في التشريع ومراعاته لأحوال المكلفين.
Abstract
This research discusses the concept of repeal (naskh) in the Quran, including its definition, and the stages through which the term repeal has evolved essential components, types, and methods of identification. It also explains the difference between repeal and similar concepts such as specification and change of mind. In addition, the study seeks to clarify the legal wisdom behind repeal by presenting practical examples from Quranic texts. The researcher adopted both inductive and descriptive methodologies. The study concludes that the essence of repeal is the annulment of a legal ruling by another legal proof, and that repeal has clear components, including: the repeal ruling, the repeal ruling, the ruling that replaces it, and the subject to which the repeal applies. Moreover, distinguishing between repeal, specification, and change of mind is necessary for understanding Islamic rulings and their stages of development. Through analyzing Quranic examples, it becomes clear that repeal is a legislative tool connected to public interest and gradual application, demonstrating Gods wisdom in legislation and His consideration of the circumstances of those who are accountable.
