الملخص
يسلط البحث ضوءه على جرائم التعزير التي توجب على هيئات المحاكمة العسكرية إيقاع العقوبة التبعية العسكرية تجاه العسكري الذي صدر حياله حكم من المحاكم الجزائية متضمنًا ثبوت التهمة المنسوبة إليه، حيث يتناول بيان ماهية جرائم التعزير بالإضافة إلى العقوبة التبعية العسكرية، كما يبين مشروعية العقوبة التبعية العسكرية وموقف المنظم السعودي من ذلك، علاوة على تقسيم جرائم التعزير من حيث الأثر المترتب عليها وظيفيًا إلى الجرائم المخلة بالشرف والأمانة والجرائم المخلة بمقتضى الواجب الوظيفي، منتهيًا إلى ما استقر عليه القضاء العسكري في تكييف تلك الجرائم.
Abstract
The research sheds light on discretionary punishment crimes that require military trial bodies to impose military accessory punishment on a soldier against whom a criminal court has issued a ruling establishing the charge against him. It addresses the nature of discretionary punishment crimes in addition to the military accessory punishment. It also demonstrates the legitimacy of the military accessory punishment and the position of the Saudi judiciary on this matter. Furthermore, it categorizes discretionary punishment crimes according to their functional impact into crimes that violate honor and trustworthiness and crimes that violate the requirements of professional duty. It concludes with the established military judiciary practices in classifying these crimes.
