الملخص
فلقد رغّب الإسلام في الزواج، وجعله آية من آيات الله تعالى، كما شرع الله سبحانه الطلاق حال النفور وعدم الاستقرار، وتعد قضية الطلاق أحد أبرز التحديات الاجتماعية في العصر الحديث، وقد أولتها الشريعة الإسلامية اهتمامًا كبيرًا، ووضعت لها الضوابط بأسلوب شامل ومتوازن، يهدف إلى الحفاظ على حقوق جميع الأطراف المعنية، وتأتي هذه الدراسة لبيان وسطية الإسلام في تشريع حق الطلاق، والحكمة في مشروعيته في كتابه الله الكريم، وسنّة رسوله صلى الله عليه وسلم، ومحافظة الإسلام على حقوق وكيان الأسرة وعدم العبث باستقرارها، والحقوق المترتبة على حالات الطلاق وأحكامها، ومراعاة الإسلام لحقوق الأسرة حال الطلاق وبعده.
Abstract
Islam has encouraged marriage and made it a sign of God Almighty, as God Almighty has legislated divorce in the event of aversion and instability. The issue of divorce is one of the most prominent social challenges in the modern era. Islamic law has paid great attention to it and set controls for it in a comprehensive and balanced manner, aiming to preserve the rights of all concerned parties. This study comes to demonstrate the moderation of Islam in legislating the right to divorce, the wisdom in its legitimacy in God’s Holy Book and the Sunnah of His Messenger, may God bless him and grant him peace, and Islam’s preservation of the rights and entity of the family and not disturbing its stability, the rights resulting from divorce cases and their provisions, and Islam’s consideration of the rights of the family in the event of divorce and after it.
