الملخص
يتناول هذا البحث قضية الانتهاكات التي يتعرض لها الأطفال الذين يعيشون في المناطق التي يكثر فيها النزاعات المسلحة والحروب، ويسعى إلى اقتراح آليات فعّالة لحمايتهم. كما يهدف إلى فهمٍ أعمقٍ لتأثير الحروب على الأطفال، وإبراز حرص الشريعة الإسلامية على صون حقوق الطفل وحمايته من المشاركة في الحروب، أو أن يتعرض للأذى والضرر، بالإضافة إلى ذلك؛ يقيّم البحث فعالية الجهود الدولية والمحلية المبذولة لحماية الأطفال، ويقدم توصيات عملية لتحسين أوضاعهم. يتضمن البحث عدة جوانب رئيسية، منها الإطار الشرعي والقانوني لحقوق الطفل في الحروب، وأنواع الانتهاكات التي يواجهونها، والجهود الدولية والمحلية المبذولة لحمايتهم، وتفصيل الحقوق التي يجب ضمانها لهم.
Abstract
“This research addresses the issue of violations against children living in areas rife with armed conflicts and wars, and proposes effective mechanisms to protect them. It also aims to gain a deeper understanding of the impact of wars on children, and to demonstrate the Islamic Sharia’s keenness to preserve the child’s rights and prevent them from participating in wars or being harmed or injured by them. Additionally, the research evaluates the effectiveness of international and local efforts made to protect children, and provides practical recommendations to improve their conditions. The research covers several key aspects, including the Sharia and legal framework of children’s rights in wars, the types of violations they face, the international and local efforts to protect them, and a detailed account of the rights that must be ensured for them.
