الملخص
التحكيم إحدى الطرق الرضائية التي يلجأ إليها المتخاصمون حال عدم اتحادهم على موقف واحد تجاه خلافهم،أو الاتفاق على حلّ مشترك بينهما لبقاء الودّ والإلقاء بالحقد وما يشوب النفس بعيدًا عن أروقة المحاكم. ليأتي البحث للحديث عن آلية التحكيم وكيفيته ليتكوّن من: ثلاثةمطالب وخاتمة، تناولالمطلب الأول مفهوم التحكيم ومشروعيته. أمّا المطلب الثاني فتحدثت فيه بشكلّ مفصّل عن كيفية التحكيم في الشريعة الإسلامية وكذلك في قانون الأحوال الشخصية الأردني. كما جاء المطلب الثالثبذكر نماذج من التحكيم المعمول بها في المحاكم الشرعية الأردنية. أمّا الخاتمة فقد جاءت متضمنة للنتائج التي توصّل إليها البحث وكذلك التوصيات التي تقترحها الباحثة.
Abstract
Arbitration is one of the consensual methods that litigants resort to in case they don’t agree on one position towards their disagreement, or when they agree on a common solution among them in order that friendliness continues and get rid of hatred and what is wrong with the soul away from the courts. So the study comes to talk about the mechanism and arbitration and how it is that is consisted of three requirements and a conclusion; the first requirement dealt with the concept of arbitration and its legitimacy, the second requirement talked in details about how to arbitrate in Sharia and in the Jordanian Personal Status Law, the third one dealt with mentioning models of arbitration in force in the Jordanian Sharia courts and the conclusion included the results that the researcher reached in addition to the recommendations proposed by the researcher.
