الملخص
يتناول هذا البحث موضوعاً مهماً في علاقة أصول الفقه بالجدل والمنطق، إذ يمهّد بالتعريف بالمغالطات المنطقية، وبمكانة علم أصول الفقه وعلاقته وتأثّره بالعلوم الأخرى، وعنايته بالأدلة وصحة الدليل وقوته، ويتركز البحث على بعض المغالطات المنطقية الجارية في نقض الاستدلال، وهي تجاهل المطلوب، من حيث المراد منه مع التمثيل لوقوع هذه المغالطة المنطقية في استدلالات الأصوليين على مسائل أصول الفقه، ووجه بيانها، في مبحثين، المبحث الأول دراسة تجاهل المطلوب، والمبحث الثاني في أثر تجاهل المطلوب في مناقشات الأصوليين في المقدمات.
Abstract
This research addresses an important topic concerning the relationship between the principles of Islamic jurisprudence (Usul al-Fiqh) and dialectics and logic. It begins by defining logical fallacies, establishing the status of Usul al-Fiqh and its relationship to and influence from other sciences, and its focus on evidence, its validity, and its strength. The research concentrates on some common logical fallacies used in refuting arguments, namely, ignoring the intended meaning of the premise. It provides examples of this logical fallacy in the arguments of Usul al-Fiqh scholars on matters of Usul al-Fiqh, and explains its manifestations in two sections. The first section examines the phenomenon of ignoring the intended meaning, while the second section explores the impact of this ignoring on Usul al-Fiqh scholars’ discussions of the premises.
