الملخص
تقوم فكرة البحث على استقراء المواد المتعلقة بحقوق الطفل في نظام الأحوال الشخصيَّة السعودي، مع شرحها شرحًا متوسطًا، وبيان مأخذها من الفقه الإسلامي وذكر المذاهب الإسلاميَّة التي اتَّفقت في ذلك، ذاكرًا الأدلَّة ما أمكن إليها سبيلًا، وقد قررت مطلبًا تمهيديًّا أبيِّن فيه مفهوم الطفل الذي يعوِّل عليه نظام الأحوال الشخصيَّة السعودي، ثم قسَّمتُ البحث إلى ثلاثة مباحث، مبحث في الحقوق المالية، ومبحث في الحقوق الاجتماعية، ومبحث في الحقوق المعنوية، وكان تحت كلِّ مبحثٍ من هذه المباحث مطالب تندرج فيها مسائل.
Abstract
The research is based on an analysis of the provisions related to children’s rights in the Saudi Personal Status Law, providing a simplified explanation of each provision, its source in Islamic jurisprudence, the Islamic schools of thought that have endorsed it, and supporting evidence whenever possible. I have established a preliminary requirement to explain the concept of “child” upon which the Personal Status Law is based. The research is then divided into three sections: one on financial rights, one on social rights, and one on moral rights. Each of these sections includes requirements that define the issues to be addressed.
