الملخص
هذه دراسة تهدف إلى إظهار المقصود بأصول المسائل الفقهية عند الإمام الشافعي، وهو مصطلح غير معرّف ولا مشروح عند علماء المذهب رغم اعتمادهم عليه في غالب كتبهم، ولإظهار أصول المسائل الفقهية التي اعتمد عليها علماء مذهبه بالترجيح والفتاوى والرد والمناظرات؛ لكون الإمام الشافعي أحد الأئمة الأربعة، ولذلك قد دعت الحاجة إلى معرفة أصوله الفقهية في فقه النكاح، فقام هذا البحث للوصول إلى هذه الأهداف.
Abstract
This study aims to clarify what is meant by fundamental jurisprudential issues according to Imam al-shafii. It is a term that is not clearly definded, nor is it widely discussed among scholars of the madhhab, despite their frequent reliance on it in most of their books. Clarifying the principles of fundamental jurisprudential issues, which scholars have relied upon by collecting and tracing them through texts and theoretical discussions, is necessary-especially since Imam al Shafii is on of the four leading Imame. This has prompted the need to identify the principles of fundamental jurisprudential issues in the jurisprudence of al-shafii. This research was conducted in an effort to reach these objectives.
