الملخص
عنوان البحث: أصول ومقاصد تحقيق الخلاف في المذهب المالكي.
منهج البحث: استقرائي تحليلي.
موضوع البحث: الوقوف على القواعد الاصولية والمقاصدية التي اعتمدها المالكية في تحقيق الخلاف.
البحث يتكون من تمهيد وثلاثة مباحث.
أما التمهيد: فيه ذكر لأهم ما تميز به الفقه الإسلامي، وبيان مكانة المذهب المالكي واهتمامه بتحقيق الخلاف.
وأما المبحث الاول: مفاهيم تأسيسية وفيه ثلاثة مطالب، وأما المبحث الثاني: أصول تحقيق الخلاف في المذهب المالكي وفيه ثلاثة مطالب، وأما المبحث الثالث: المقاصد الشرعية وأثرها في تحقيق الخلاف.
أبرز النتائج: المذهب المالكي من أبرز المذاهب التي اهتمت بتحقيق الخلاف، ووضع القواعد التي تراعي الخلاف قبل وقوعه والخروج منه بعد وقوعه.
Abstract
Title: The Principles and Objectives of Verifying Juristic Disagreement in the Mālikī School.
Methodology: An inductive–analytical approach.
Subject of the Research: Examining the uṣūlī (legal-theoretical) and maqāṣidī (objectives-based) principles upon which the Mālikī School relied in verifying juristic disagreement.
Structure of the Study: The thesis consists of an introduction and five chapters.
The Introduction includes a presentation of the most prominent features of Islamic jurisprudence, and a clarification of the status of the Mālikī School and its concern with verifying juristic disagreement.
Chapter One addresses foundational concepts and comprises three sections.
Chapter Two discusses the principles of verifying disagreement in the Mālikī School and comprises three sections.
Chapter Three examines the principles of considering juristic disagreement according to the Mālikīs and comprises three sections.
Chapter Four deals with the Sharīʿah objectives and their impact on verifying disagreement and comprises three sections.
Chapter Five presents applications of considering juristic disagreement in the Mālikī School and comprises three sections.
Key Findings: The Mālikī school is among the most prominent schools that paid special attention to verifying juristic disagreement, and it established principles that take disagreement into account both before its occurrence and in resolving it after it occurs.
Disagreement occurs more frequently in uṣūlī principles than in substantive juristic (fiqhī)rules.
