الملخص
يتناول هذا البحث دراسة أثر علم أصول الفقه في حفظ خصائص الشريعة، من خلال بيان المفهوم الصحيح لربانية الشريعة وسيادتها، وإحكامها وعمومها، ويسرها وكمالها، وتقرير ذلك في ضوء نصوص الكتاب والسنة، ثم إبراز الدور الذي اضطلع به علم أصول الفقه في صيانة هذه الخصائص العظيمة. ويهدف البحث إلى بيان أن علم أصول الفقه لم يكن علمًا آليًا مجردًا، بل كان سياجًا علميًا ومنهجيًا حافظًا لمرجعية الوحي، وضابطًا لعملية الاجتهاد، ومانعًا من تحكيم الأهواء والعقول المجردة في التشريع. وقد اعتمد البحث على المنهج الاستقرائي التحليلي، باستقراء النصوص الشرعية والقواعد الأصولية ذات الصلة، وتحليل أثرها في حفظ ربانية الشريعة وسيادتها، وإحكامها، وعمومها، ويسرها، وكمالها، وقد جعل الباحث بحثه في مقدمة وخاتمة، بينهما خمسة مباحث، تحت كل مبحث ثلاثة مطالب، وختمه بذكر فهرس المصادر والمراجع. وخلص البحث إلى جملة من النتائج:
1- أهمية علم أصول الفقه، ودوره في حفظ الشريعة، بمختلف الطرق والوسائل.
2- دور أصول الفقه في توضيح محاسن الدين الإسلامي، وما تميز به من خصائص.
3- حفظ الله لشريعته وتسخير العلوم لخدمة هذا الدين، لا سيما علم أصول الفقه.
Abstract
This research examines the impact of Usul al-Fiqh (Principles of Islamic Jurisprudence) in preserving the characteristics of Islamic law, by clarifying the correct understanding of the divine nature and sovereignty of the Shariah, its precision and comprehensiveness, its ease and perfection, and by establishing these meanings in light of the texts of the Qur’an and the Sunnah. It then highlights the role undertaken by Usul al-Fiqh in safeguarding these great characteristics.
The study aims to demonstrate that Usul al-Fiqh was not merely a technical or instrumental discipline, but rather a scientific and methodological safeguard that preserved the authority of revelation, regulated the process of juristic reasoning (ijtihad), and prevented the dominance of whims and abstract human reasoning in legislation.
The research adopts an inductive and analytical methodology, through surveying relevant legal texts and foundational juristic principles, and analyzing their impact on preserving the divine nature and sovereignty of the Shariah, as well as its precision, universality, ease, and perfection. The researcher structured the study with an introduction and a conclusion, between which are five chapters, each consisting of three sections, and concluded with a bibliography of sources and references.
The research reached several conclusions, most notably:
1- The importance of Usul al-Fiqh and its role in preserving Islamic law through various means and methods.
2- The role of Usul al-Fiqh in clarifying the virtues of Islam and the distinctive characteristics that set it apart.
3- Allah’s preservation of His Shariah and His facilitation of various sciences to serve this religion, especially the science of Usul al-Fiqh.
