الملخص
تهدف هذه الدراسة إلى جمع المسائل الفقهية المحددة بثلاثة أيام في كتاب البيوع ودراستها دراسة فقهية مقارنة، سلكت فيها المنهج الاستقرائي والمنهج المقارن، وقد جاءت الدراسة في مبحثين، المبحث الأول: في التعريف بمفردات العنوان، وفيه بيان مفهوم التحديد، والمراد بالمدة واليوم، وتعريف البيع، وبيان الحكمة من تحديد الأحكام الفقهية بمدة ثلاثة أيام، وأما المبحث الثاني: فكان في ذكر المسائل الفقهية، وبلغ عددها عشر مسائل، ودرست المسائل بتحرير محل النزاع فيها، وذكر الأقوال الواردة في المسألة، وبيان القول الراجح منها بدليله، وظهر من خلال هذه الدراسة تنوع المسائل الفقهية المحددة بثلاثة أيام في كتاب البيوع واختلافها، وأنها ليست على درجة واحدة من حيث القوة.
Abstract
This study aims to compile the juristic issues restricted to a period of three days in the Book of Sales and to examine them through a comparative fiqh-based analysis. The research adopts both the inductive and comparative methodologies. The study is structured into two main sections. The first section introduces the key components of the title, clarifying the concept of restriction, the intended meaning of a time period and a day, defining sale, and explaining the wisdom behind restricting certain juristic rulings to a three-day period. The second section addresses the juristic issues themselves, which number ten. Each issue is examined by precisely delineating the point of juristic disagreement, presenting the various scholarly opinions related to the issue, and identifying the preponderant view supported by its evidence. The study reveals the diversity of juristic issues restricted to three days within the Book of Sales, as well as their differences, indicating that they do not hold the same level of juristic strength.
