الملخص
يتناول هذا البحث دراسةً وصفية تحليليةً للمسائل الخلافية داخل المذهب الحنبلي في كتاب الاعتكاف التي وردت في كتاب زاد المستقنع للإمام الحجاوي، وذلك بعنوان: «المسائل الخلافية في المذهب الحنبلي: تاريخها ونشأتها في كتاب الاعتكاف (جمعًا ودراسة).
وتبرز أهمية هذا البحث في كونه يُسهم في جمع الروايات عن الإمام أحمد رحمه الله وبيان التطور التاريخي للمسائل الخلافية داخل المذهب، وتتبع أصول الخلاف ومنشأه، وتحرير القول المعتمد عند المتأخرين، وبيان مدى موافقة المتأخرين لقول الإمام أحمد رحمه الله ونصه في المسائل محل البحث.
وقد اعتمدت الدراسة المنهج الاستقرائي التحليلي؛ حيث قامت الباحثة بجمع نصوص الروايات المتعلقة بمسائل الاعتكاف من المصادر المعتمدة للمذهب، ثم تتبع مسار الخلاف بين المتقدمين والمتأخرين، وتحليل نصوصهم، وتبيّن أثر اختلاف الرواية أو تغير العلة أو قوة الدليل في نشأة الخلاف وتطوره.
أظهرت نتائج البحث أن المذهب الحنبلي استقرّ عند متأخريه على اعتماد الروايات المشهورة عن الإمام أحمد في الغالب، مع توجيه الروايات الأخرى بما يتفق مع قواعد المذهب وأصوله، وأن الاختلاف بين المتأخرين ونصوص الإمام أحمد غالبًا ما يكون في زيادة قيد أو تفريع وتخريج على قول الإمام، وأن المخالفة الصريحة نادرة.
ويوصي البحث بضرورة استكمال دراسة المسائل الخلافية في بقية أبواب الفقه، وتعزيز الجهد العلمي في تحرير روايات الإمام أحمد، والعناية بالدراسات المقارنة داخل المذهب، لما لذلك من أثرٍ بالغ في فهم البناء الفقهي وتطوره لدى الحنابلة.
Abstract
This study presents a descriptive and analytical examination of the contentious issues within the Hanbali school of law as they appear in the Book of Iʿtikāf in Zād al-Mustaḳniʿ by Imam al-Ḥajjāwī. The research is titled: “Contentious Issues in the Hanbali School: Their History and Development in the Book of Itikaf (Compilation and Analytical Study).”
The significance of this study lies in its contribution to collecting the transmitted reports from Imam Aḥmad ibn Ḥanbal, elucidating the historical development of intra-madhhab disagreements, tracing the roots and origins of such disputes, identifying the positions later scholars adopted as authoritative, and assessing the degree to which these later positions align with the explicit statements of Imam Aḥmad in the issues under investigation.
The research adopts an inductive and analytical methodology. The researcher compiled the relevant textual reports concerning the rulings of iʿtikāf from the authoritative sources of the Hanbali school, traced the trajectory of disagreement between early and later scholars, analyzed their statements, and examined how variations in narration, shifts in legal reasoning, or differing strengths of evidence contributed to the emergence and development of these disagreements.
The findings indicate that later Hanbali scholars generally relied on the well-known and predominant narrations from Imam Aḥmad, while interpreting other narrations in ways consistent with the established principles and methodological foundations of the school. The study further concludes that divergences between later scholars and Imam Aḥmad’s explicit statements typically reflect the addition of qualifying conditions, the derivation of subsidiary rulings, or the application of juristic principles—rather than explicit disagreement, which is rare.
The study recommends extending similar analytical work to the remaining chapters of jurisprudence, strengthening scholarly efforts to refine and organize the narrations of Imam Aḥmad, and promoting comparative intra-madhhab research due to its substantial role in understanding the development and structure of Hanbali legal thought.
