الملخص
هذه دراسة تهدف إلى إظهار أصول المسائل الفقهية في المذهب الشافعي في كتاب البيوع، واستعراض بعض أصول البيوع وتنقيح المناط فيها ونقل كلام الأصحاب في تقريرها، وأخيراً التخريج على هذه الأصول بالفروع الفقهية، ولإظهار أصول المسائل الفقهية في المذهب الشافعي أهمية كبيرة في ضبط الأصول في الأبواب الفقهية.
Abstract
This study aims to elucidate the foundational principles of Islamic jurisprudence (fiqh) in the Shafi’i school of thought, specifically within the chapter on sales. It reviews some of these principles, clarifies their underlying rationale, presents the opinions of the scholars on their application, and finally, derives specific legal rulings from them. Demonstrating the fundamental principles of Islamic jurisprudence within the Shafi’i school is of paramount importance for establishing the principles of legal rulings across various chapters of Islamic law.
