الملخص
هذا البحث بعنوان ” ثبوت الحكم بين النص والعلة، وأثره في مسائل مستجدة” يلقي الضوء على بيان ثبوت الحكم، في مسائل حادثة تتطلّب اجتهاداً للحكم عليها، لا سيما في ميدان الطبّ وعلوم الأحياء؛ حيث إن هذه المسائل غير مبنية على نصّ صريح.
فكان البحث محاولة لدراسة تحليلية لكيفية ثبوت الحكم بين النص والعلة؛ مظهراً الحكم من وجهة نظر أصولية، عارضًا أقوال العلماء مع الوقوف على أدلتهم، ثم الترجيح بين هذه الأقوال.
وقد تناول البحث مسألتَي وهب الأعضاء، والانتفاع بالخلايا الجذعية، مستعيناً بالقياس ومجالات استعمالاته للوصول إلى كلمة الفصل فيهما.
Abstract
This is a paper titled “Proof of Judgment between Text and Reason and its Impact on Mosque Matters”. It highlights the proven judgment in the first place, in matters of incident, which require diligence to judge, particularly in the field of medicine and biology, as these issues are not based on explicit text. The research was an attempt to analyze how the judgment between text and reason proved judgment from a fundamentalist point of view, presenting the statements of scientists with evidence. The research addressed the issues of organ donation and stem cell utilization using measurement and its areas of use to reach the final word.
