الملخص
هذا البحث يبرز الدور الحيوي للمبادئ والسوابق القضائية في تشكيل وعي مجتمعي قائم على التسامح، ويوضح كيفية توظيف القضاء كأداة لحماية النسيج الاجتماعي ويساهم في تقديم توصيات لتعزيز العدالة كدعامة لاستدامة السلم المجتمعي. وليس للسوابق القضائية في الشريعة الإسلامية حجية تجعلها من القوة بحيث لا يستطيع القاضي اللاحق مخالفة القاضي السابق في ذلك الحكم. وقد كان القضاء بما قضى به الصالحون منهجًا لدى سلفنا الصالح رحمهم الله ومما قرره الفقهاء ضرورة اطلاع القاضي على أحكام من سبقه من القضاة لينهل منها، وتكون له موردًا معينًا.
Abstract
This study highlights the pivotal role of judicial principles and precedents in fostering a societal culture grounded in tolerance and moderation. It explores how the judiciary can serve as a mechanism to protect the social fabric and offers recommendations to strengthen justice as a cornerstone for sustainable societal harmony.
In Islamic jurisprudence, judicial precedents do not carry binding authority such that subsequent judges are obligated to follow earlier rulings. However, reviewing the judgments of previous upright judges was a well-established practice among early Muslim jurists. Classical scholars emphasized the importance of judges familiarizing themselves with earlier rulings—not as binding precedents, but as valuable jurisprudential references from which insight and guidance may be drawn.
