الملخص
يتناول هذا البحث: بيان حكم تقليد غير المذاهب الفقهيّة الأربعة في الإفتاء والقضاء، وما يتعلّق بالموضوع من: بيانٍ لمعنى التّقليد، والإفتاء، والقضاء، وعرضٍ لأقوال العلماء، ومناقشتها؛ وصولاً إلى الحكم.
ولتحقيق هدف البحث؛ اتّبع الباحث: المنهج الاستقرائيّ؛ القائم على تتبّع واستقصاء الفروع الفقهيّة، وكذا المسائل الأصوليّة المتعلّقة بتقليد غير المذاهب الفقهيّة الأربعة. ومن ثمّ استخدم: المنهج الوصفيّ التّحليليّ؛ وذلك لتوصيف اتّجاهات العلماء في هذه المسألة، وتحليلها؛ للوقوف على حقيقتها، وتحديد المحاور الأساسيّة الّتي تُبنى عليها.
وتوصّلت الدّراسة إلى: جواز تقليد غير المذاهب الفقهيّة الأربعة في الإفتاء والقضاء؛ وذلك من خلال الجمعِ والتّوفيق بين أقوال العلماء، مع مراعاة ما وضعوه من شروط وضوابط.
Abstract
This research deals with: an explanation of the ruling on following other than the four schools of jurisprudence in issuing fatwas and rulings, and what is related to the subject, including: an explanation of the meaning of following, issuing fatwas, and ruling, and presenting the scholars’ sayings and discussing them, leading to the ruling.
Toachieve the research goal, the researcher followed: the inductive approach; Based on tracking and investigating the branches of jurisprudence, as well as fundamental issues related to following other than the four schools of jurisprudence. Then he used: the descriptive analytical method; In order to describe the trends of scholars on this issue and analyze it. To determine its truth, and to determine the basic axes on which it is built.
The researcher concluded: It is permissible to follow other than the four jurisprudential schools of thought in issuing fatwas and rulings; This is done by combining and reconciling the statements of scholars, taking into account the conditions and controls they have set.
